What is an Underground Storage Tank? (UST) • Definition: • Stationary device designed to contain an accumulation of “regulated” substances; • Constructed of non-earthen materials (e.g., concrete, steel, fiberglass reinforced plastic) that provide structural support; and • Volume of which is 10% or more beneath the surface of the ground (including the associated underground piping.)

Regulated Substance • UST – 40 CFR 280.12 • CERCLA substance on 101(14) list • Petroleum • Liquid at standard temperature and pressure • Motor fuels, jet fuels, distillate fuel oils, residual fuel oils, lubricants, petroleum solvents and used oils
Regulated Substance • AST – APC&EC Regulation 12.103 (B)(1)(a) and (b) • Motor fuels, distillate special fuels, or other refined petroleum products • No CERCLA substances (101.14 list)
Tanks Requiring Registration (Not a “Permit” program) • USTs • > 110 gallons • Storing a regulated substance • Not exempted or deferred by federal regulations • ASTs • 1,320 – 40,000 gallons • Storing a regulated substance • Not excluded by state regulations (i.e., farm tanks, transitory tanks, tanks used in the production of petroleum or natural gas)
How To Register USTs/ASTs • Two Different ADEQ Forms • Forms include: • Registration form • Financial assurance form (UST required, AST optional)
How to register (cont.) • Registration fee of $75.00/tank/year • Certificate issued (annual sticker)

“The Big Picture” Compliance Requirements for Piping • Pressurized piping • Automatic line leak detector; and • Monthly monitoring or annual tightness test • Suction piping • “Safe” suction (European system) • Conventional suction (American system) • Monthly monitoring or tightness test
Release Prevention • Spill prevention • Overfill prevention • Corrosion Protection
Visual or Audio Alarm Must be where driver can see or hear alarm!
Reporting Suspected Releases • Report suspected release to ADEQ within 24 hours, if: • Free product or vapors are discovered at a tank site or surrounding area • Unusual operating conditions are observed • Sudden loss of product • Unexplained water in tank • Erratic dispensing • Monthly monitoring indicates a release (USTs only)
Reporting Suspected Releases (Continued) Upon receipt of a suspected release report, the RST Division staff will guide the tank owner/operator through the steps of confirmation/denial, investigation, assessment, and cleanup (as necessary).
