  2. Purpose of Today’s Session • Explain Permit Reissuance Schedule and Public Process • Explain changes proposed by Ecology • Answer questions

  3. Reissuance Background • Federal regulations: NPDES Permits cant be issued for more than 5 years • Current Permit expires Jan 1, 2015 • Federal regulations: Facilities must re-apply 180 days before expiration • Ecology sent instructions in May • Electronic Applications • Due date: July 5, 2014

  4. Reissuance Schedule • May 7: Ecology released Draft Permit and Fact Sheet • Began Public Comment Period • May-June: Public Workshops/Hearings • June 20: Close Public Comment Period • Ecology reviews public comments • Makes appropriate revisions

  5. Reissuance Schedule • Nov 19: Issue Final Permit • Response to Comments • Permit coverage issued to facilities • Appealable • Jan 1, 2015: Final Permit Effective • Supersedes existing permit

  6. Industrial Stormwater Website

  7. Proposed Changes • Most permit conditions unchanged • Revisions proposed to: • Improve clarity and reduce confusion; • Implement new Federal Regulations; • Streamline Level 3 Engineering Reports; • Improve protection of Puget Sound Sediment Cleanup Sites.

  8. Proposed Changes • Permit Coverage • SWPPP/Best Management Practices • Sampling • Benchmarks • Corrective Actions • Impaired Waters • Reporting

  9. Proposed Changes • Permit Coverage • SWPPP/Best Management Practices • Sampling • Benchmarks • Corrective Actions • Impaired Waters • Reporting

  10. S1. Permit Coverage • Facilities engaged in Industrial activity - Table 1 • Manufacturing • Warehousing • Processing • Waste Disposal/Recycling • Transportation – if vehicle maintenance activity, equipment cleaning operations, or airport de-icing and • Stormwater discharges to surface waters or storm drain connected to surface waters

  17. S4. Sampling • Sample Timing • One sample per quarter • Sample “1st Fall Flush” on or after Oct 1st • Sample within 12 hrs of discharge • Sampling Locations • All discharge points sampled unless “substantially identical” • If numeric effluent limits, must sample those parameters at each discharge point.

  18. S4. Sampling • “Consistent Attainment” of Benchmark – Suspend Sampling • 8 consecutive quarters • “No Discharge” quarters don’t reset the consistent attainment tally

  19. S4. Sampling • Quarterly Averaging Clarified • If multiple samples collected – average results and compare to benchmark • Language added to clarify how to calculate quarterly average when multiple samples are collected during a single day.

  20. Proposed Changes • Facilities covered under the Permit • SWPPP/Best Management Practices • Sampling • Benchmarks • Corrective Actions • Impaired Waters • Reporting

  21. S5. Benchmarks

  22. S5. Additional Benchmarks • Chemical & Allied Products; Food & Kindred Products • BOD5 30 mg/L; Nitrogen 0.68 mg/L; Phosphorus 2.0 mg/L • Primary Metals; Metals Mining; Automobile Salvage & Scrap Recycling; Metals Fabricating • Lead 81.6 µg/L; Petroleum (TPH-Dx)10mg/L • Hazardous Waste TSDs • 12 additional parameters (see permit) • Air Transportation • Ammonia 2.1 mg/L; BOD5 30 mg/L; COD 120 mg/L; Nitrate/Nitrite , as N 0.68 mg/L • Timber Products; Paper and Allied Products • COD 120 mg/L, and TSS 100 mg/L

  23. S5. Additional Benchmarks • Chemical & Allied Products; Food & Kindred Products • BOD5 30 mg/L; Nitrogen 0.68 mg/L; Phosphorus 2.0 mg/L • Primary Metals; Metals Mining; Automobile Salvage & Scrap Recycling; Metals Fabricating • Lead 81.6 µg/L; Petroleum (TPH-Dx)10mg/L • Hazardous Waste TSDs • 12 additional parameters (see permit) • Air Transportation • Ammonia 2.1 mg/L; BOD5 30 mg/L; COD 120 mg/L; Nitrate/Nitrite , as N 0.68 mg/L; Petroleum (TPH-Dx)10mg/L • Timber Products; Paper and Allied Products • COD 120 mg/L, and TSS 100 mg/L • Transportation; Petroleum Bulk Stations and Terminals • Petroleum (TPH-Dx)10mg/L

  24. S5. Effluent Limits • New Federal Regulations • 2012 Federal Effluent Limitation Guidelines and New Source Performance Standards for Airport Deicing • Airports with 1000+ annual jet departures • Daily Max Limit: 14.7 mg/L Total Ammonia (as N); or • Use “non-urea containing deicers”; certify in Annual Report • New Airports with 10,000+ annual jet departures • Not eligible for ISGP • Need Individual Permit

  25. Proposed Changes • Permit Coverage • SWPPP/Best Management Practices • Sampling • Benchmarks • Corrective Actions • Impaired Waters • Reporting

  26. S8. Corrective Actions • 3 Types of Corrective Actions: • Level 1 – Operational Source Control BMPs • Level 2 – Structural Source Control BMPs • Level 3 – Treatment BMPs

  27. S8. Corrective Actions • 3 Types of Corrective Actions: • Level 1 – Operational Source Control BMPs • Each time benchmark exceeded • Level 2 – Structural Source Control BMPs • Benchmark exceeded 2 Quarters/Year • Level 3 – Treatment BMPs • Benchmark exceeded 3 Quarters/Year

  28. Level 1 - Operational Source Control Example: Increase Sweeping Example: Clean Up Spills

  29. S8. Corrective Actions • 3 Types of Corrective Actions: • Level 1 – Operational Source Control BMPs • Each time benchmark exceeded • Level 2 – Structural Source Control BMPs • Benchmark exceeded 2 Quarters/Year • Level 3 – Treatment BMPs • Benchmark exceeded 3 Quarters/Year
