Other Reasons for Suspension • Failure to appear in court • Failure to pay surcharges • At fault in a fatal accident • Driving while suspended • Failure to provide proof of insurance • Drug or alcohol use • Reckless driving • Repeated traffic law violation
Underage Drinking pg111 • It is illegal to purchase, possess, or consume alcohol if under 21 • 1st offense Consequences • fine • 30-90 suspension • 15-30 days community service • May need to attend an alcohol ed or treatment program • If you don’t have a license yet it starts when you are 1st eligible to receive a license
DUI PenaltiesBAC .08% but below .10% pg111 First offense • 3-month suspension • $250-$400 • 12-48-hr participation in an Intoxicated Drivers Resource Center (IDRC) • $230 per day IDRC fee • Up to 30 day imprisonment
$100 Drunk Driving fee • $100 alcohol ed rehab fee • $1000 annual surcharge for 3 years • $75 safe Neighborhood Services fee • Possible interlock device requirement for 6 months to 1 year

Ignition Interlock Device pg116 • This is installed after suspension is up • Cost is on the motorist • This is a built in breathalyzer • Car will not start if BAC is above .05% • 1st offense BAC of less than .15% for 6 months to 1 year (this is up to the judge) • 1st offense BAC of more .15% or higher or refusal to breathe test for 6 months to 1 year • 2nd offense or another breath test for refusal1-3 years
Intoxicated Driver Resource Center pg116 • Alcohol and highway safety education program • Evaluates for alcohol or drug problems • Those who are considered to have a problem are sent to a 16 week program • Failure to comply • Further loss of license • Imprisonment
Motor Vehicle Violations pg116 • Unsafe Driving: fine, points, court surcharge • Reckless driving: fine, points, imprisonment • Abandoning a vehicle: fine, and suspension • Carrying open alcohol: fine, 10 days community service
Ice and snow: $200-$1000fine • Highway Construction Zones: fines double • 65 mph zone: 10 mph over = double the fines • Failure to Comply: Fine if you refuse to put on your inside car lights • Hit-and-run: fine, jail and suspension • Drug offense: Suspension and conviction of state or federal court
Non driving violations • Insurance fraud: fines imprisonment suspension • Lying on Drivers or registration application: $200-$500 fine, and/or 6 months jail • Forgery and fraud: altering or forging license up to a 150,000 fine and 10 years imprisonment • Driving while suspended: additional 6 months with each time, fine and jail • Graffiti: suspension or postponement • 6 months back child support: suspension
Driver Programs pg120 • Suspension:12-14 pts in a 24 month period • Your options: • Attend a NJ driver improvement program • Request a hearing • Surrender license
Defensive Driving Courses • 2pt deduction from license • May qualify for insurance reduction • MVC will recognize this class every 5 years for the 2pt deduction
Probationary Driver Program • 2-yr probationary period after permit. • Convicted of 2 or more moving violations totaling 4 or more pts, motorists must enroll in Probationary Driver Program • $75 fee • 3pt deduction at completion of course
Mature Driver • Driver should re-evaluate driving skills • Special programs are designed for motorist age 50 and up • 8 hour course helps refine and develop safe defensive driving techniques • Bonus: possible insurance discount
Motor Vehicle Surcharges and point Violations pg122 • 6 or more pts in 3 years = $150 surcharge • $25 for each addition pt • Driving classes do not subtract pts for surcharges
Point System pg123 • 3pts are subtracted each year as long as you have not had any violations • See charts on pgs 124-126 • Interstate Compacts • Pts and suspensions carry over from other states
