Case Reading ChecklistBEFORE READING • What is your purpose in reading? • How much time do you have to read this case? • Do you have the energy and focus to actively read? • Put the case in context: • Where does the case fit into the course syllabus and casebook table of contents? • Look at the Heading/ Caption: • Name of the case, citation, judge’s name, court and date • Look at how the case is organized • Any headings?
Case Reading Checklist 1st Read: • Read case for overview • Who are the parties? • Who won? • What is case generally about? • Picture the facts • What happened? 2ndRead • Read case carefully again • Have a Black’s Law Dictionary Handy • Look up words you don’t understand • Make sure you understand the facts completely • Read to understand main idea, holding & rationale • Make margin notes & highlight • If part of case is confusing, spend extra time on that part
Case Reading Checklist 3rd Read: • Brief case • What are the key facts? • Focus on understanding IRAC: • ISSUE • What is the primary issue(s)? • RULE • Synthesize the rule of law. • ANALYSIS • Consider the court’s rationale. • How did the court apply the rule of law to the facts? • CONCLUSION • What is the court’s answer to the issue before it? • Think on how case fits together with other cases in this section of the course syllabus and casebook table of contents? • Think on how holding would be different if the facts were different • Compile a list of questions for further research
