  2. IDEA 2004 • Reauthorization signed by President in December 2004 • Final regulation released in August 2006 • Implementation by October 2006

  3. IDEA 2004 • Accountability • Participation in Assessment System • Highly Qualified Teachers • Eligibility for Services • Instructional Practices and Interventions • IEP Development and Parent Involvement • Dispute Resolution

  4. Virginia Department of Education • VDOE is currently: • Developing a technical assistance guidance document, which outlines key changes; • Revising the Procedural Safeguards Document; and • Scheduling regional training for all Directors for October and November 2006

  5. Virginia Department of Education • Must comply with Virginia’s Administrative Process ACT • Approximately 18-19 months to complete • October 25, 2006-The Notice of Intended Regulatory Action (NOIRA) scheduled to be presented to Virginia Board of Education for review. This will begin the APA process • Once approved, there will be two public comment periods which will begin in December. • In the meantime, use 2002 regulations except where there is direct conflict with new federal mandates.

Preparation: Current Activities 2006-2007 • Incorporating changes in special education procedures related to eligibility, placement and services • Reviewing IEP Online for compliance and accountability reporting • Reviewing paperwork and use of technology to address efficiency and paperwork reduction
