  2. NATIONAL POWERS • 10th Amendment- Establishes National powers • The powers not delegated to the United States by the Constitution, nor prohibited to the States respectively, or to the people.

  3. Expressed or Enumerated Powers • Clearly written powers in the Constitution • Coining Money • Regulating Interstate Commerce • Levying and Collecting Taxes • Declaring War • Establishing Post Offices • Making Treaties • Appointing Federal Office Holders • Granting Pardons

  4. IMPLIED POWERS • Not written in the Constitution, but suggested. • Article I Sec 8 (Legislature) • To make all laws which shall be necessary and proper for carrying into Execution the foregoing powers and all other Powers vested by this Constitution…

  5. Necessary and Proper • Otherwise known as the elastic clause • Gives Congress all the powers that are not expressly stated in the Constitution • Making the Constitution, flexible.

  6. Inherent Powers • Inherent Means Naturally Occurring • Make treaties • Regulate immigration • Claim territory • Wage war • Create Peace

  7. Prohibited Powers • Powers give expressly to the states • The Bill of Rights

  8. RESERVED POWERS • Powers reserved for the states • Regulate Intrastate Commerce • Conduct Elections • Provide for Health, safety, morality • Establish local GOVs • Ratify amendments to Constitution • Establish state militias

  9. CONCURRENT POWERS • Powers shared by both Federal and State • Levy and collect taxes • Borrow money • Make and enforce laws • Establish courts • General welfare • banks

  10. Powers Denied • To both Federal and State GOVs • Titles of Nobility • Permit slavery • Deny citizens the right to vote
