  3. Local Special Bodiesper RA 7160 Local School Board have advisory or recommendatory powers and direct powers that cannot be delegated. It also determines budgetary needs and disbursement from the Special Education Fund. Local School Boards Local Health Board Local Development Councils Local Peace and Order Councils

  4. What is a Local Housing Board? A Local Housing Board is a local special body devoted to addressing shelter concerns through the formulation, development of a comprehensive and integrated housing and land development program of the LGU.

Functions of the LHB Policy making body on shelter and urban development matters Ensure the implementation of UDHA Assist LGUs in the preparation of Local Shelter Plan and Comprehensive Land Use Plan Recommend/identify housing related projects Assist LGUs in review and approval of Subdivision Plans Assist LGUs in monitoring compliance to balanced housing Recommend use/allocation of Special Housing Fund Act as One-Stop Shop Processing Center for Housing Permits Act as Clearinghouse for eviction and demolition Facilitate beneficiary selection and qualification of beneficiaries in the disposition of proclaimed government properties

  6. How is the Local Housing Board created? The Board may be created by an Ordinance approved by the local Sanggunian. It may also be created by the Local Chief Executive through an Administrative Order creating the Local Housing Board (LHB) .

Legal Basis • The creation of any of the organizational structures listed above is authorized by Section 18 of the Local Government Code • the LGUS shall have the power and authority to establish any organization that shall efficiently and effectively implement its development plans, programs and projects. • More specifically, the UDHA has devolved to the LGUS the task of implementing the socialized housing program in their respective jurisdictions.

Function of LHB in DILG MC 2008-143 • Monitor all evictions and demolitions, whether voluntary, extra-judicial, summary or court-ordered • Require proponents to first secure Checklist, Guidelines and Eviction and Demolition Compliance Certificate prior to actual implementation • Issue an Eviction and Demolition Compliance Certificate on proposed eviction and demolition • Specific to Sections 28 and 30 of RA 7279

Features of DILG MC 2008-143 • Requires every Mayor to cause the creation of the Board through appropriate ordinance as a pre-requisite before the LGU can assume its clearinghouse function. • For an existing LHB, an amendment of the ordinance shall be enacted to conform with the guidelines without altering the original composition.

Sample Ordinance: Island Garden City of Samal To study, review, recommend, consolidate and endorse shelter development issues in the barangay, in aide of legislation by the Sanggunian, to address the needs of the urban poor; To study, review, recommend and endorse proposals to the formulation of a local shelter plan of the City; To design and propose recommendation for the SHELTER development program for the urban poor in the City to wit: 1) social infrastructure; 2) Housing and Development; 3) Environmental Consciousness; 4) land acquisition; 5) Training and Education; 6) Economic Enhancement; and Research and Documentation;

Sample Ordinance: Island Garden City of Samal To design programs, strategic plans, and to propose recommendations for sources of funds, flotation of bonds and other strategies for housing finance in partnership with the private sector, cooperatives and NGOs; To study, review and recommend appropriate actions and/or intervention for cases involving demolition, relocation initiated by private landowners/developers, relocation and resettlement of settlers in danger zones, including areas occupied by settlers owned either by the government and private landowners

Suggested Composition It shall be composed of the Mayor as Chairman; Vice Mayor as Vice Chairman; a representative from the local Sanggunian, the City/Municipal Planning and Development Coordinator or Engineer, the Assessor and the Treasurer. • LGU • MPDC, MSWDO, UPAO, MEnro, MLGOO, Chief of Police/PNP, Sanggunian, Head of Housing Committee of the SB • NGAs • Representatives from Key Housing Agencies: HUDCC, NHA, HLURB, HDMF • Other agencies • Private Sector • Representatives from People’s Organizations, NGOs, Developers, Home Owners’ Associations, Neighborhood Associations

Local Housing Office • The LHB may establish a Local Housing Office (LHO) which shall implement the policies, plans and programs adopted by the Board. • The City/Municipal Mayor may appoint a General Manager of the LHO who shall serve on a full-time basis. • The LHO may be composed of the following divisions : Administrative/Records; Technical; Community Affairs

  24. Special Housing And Trust Funds • Legal Basis Section 43 of RA 7279 • “Sec. 43. Socialized Housing Tax – Consistent with the constitutional principle that the ownership and enjoyment of property bear a social function and to raise funds for the Program, all local government units are hereby authorized to impose an additional one-half percent ((0.5%) tax on the assessed value of all lands in urban areas in excess of Fifty thousand pesos (P50,000.00). • DOF Local Finance Circular No. 1-97 dated April 10, 1997provides for the implementing rules and regulations for the SHT.

  25. Balanced 20 Percent Sec. 18. Balanced Housing Development - The Program shall include a system to be specified in the Framework plan whereby developers of proposed subdivision projects shall be required to develop an area for socialized housing equivalent to at least twenty percent (20%) of the total subdivision area or total subdivision project cost, at the option of the developer, within the same city or municipality , whenever feasible, and in accordance with the standards set by the Housing and Land Use Regulatory Board and other existing laws.

  26. Balanced 20 Percent • The balanced housing development as herein required may also be complied with by the developers concerned in any of the following manner: • Development of new settlement; • Slum upgrading or renewal of areas for priority development either through zonal improvement programs or slum improvement and resettlement programs; • Joint-venture projects with either the local government units or any of the housing agencies; or • Participation in the community mortgage program.

RA 10121 Disaster Risk Reduction and Management Act Recognize and strengthen the capacities of LGUs and communities in mitigating and preparing for, responding to, and recovering from the impact of disasters Recognize the local risk patterns across the country and strengthen the capacity of LGUs for disaster risk reduction and management through decentralized powers, responsibilities and resources…

  31. Mitigation • structural and non-structural measures undertaken to limit the adverse impact of natural hazards, environmental degradation, and technological hazards and to ensure the ability of at-risk communities to address vulnerabilities aimed at minimizing the impact of disasters. • Such measures include, but are not limited to, • hazard-resistant construction and engineering works, • the formulation and implementation of plans, programs, projects and activities, • awareness raising, knowledgemanagement, • policies on land-use and resource management, as well as the enforcement of comprehensive land-use planning, building and safety standards, and legislation.

  32. Disaster Prevention • (l) "Disaster Prevention"- the outright avoidance of adverse impacts of hazards and related disasters. • It expresses the concept and intention to completely avoid potential adverse impacts through action taken in advance such as • construction of dams or embankments that eliminate flood risks, • land-use regulations that do not permit any settlement in high-risk zones,and • seismic engineering designs that ensure the survival and function of a critical building in any likely earthquake.

  33. Local Disaster Risk Reduction and Management Fund (RA 10121) • Not less than five percent (5%) to support disaster risk management activities such as, but not limited to, pre-disaster preparedness programs including training, purchasing life-saving rescue equipment, supplies and medicines, for post-disaster activities, for the payment of premiums on calamity insurance and construction of evacuation centers. • Quick Response Fund (QRF)– 30%stand-by funds for relief and recovery programs • Special Trust Fund - Unexpended LDRRMF shall accrue to a special trust fund solely for the purpose of supporting disaster risk reduction and management activities of the LDRRM Council within the next five (5) years .
