INSPECTIONS • Compliance officers cannot give any advanced notice of his or her inspections ; considered a class 2 misdemeanor , 6 months jail time or $1,000 fine. • Employers have the right to refuse an inspection!
Multi-Employer worksite • Controlling: An employer who has general supervisory authority over the worksite, including the power to correct violations or require others to correct them. • Correcting: An employer who is responsible for correcting a hazard.
Multi-Employer worksite cont’d • Creating: The employer that created a hazardous condition that violates an OSHA standard or the General Duty Clause • Exposing: An employer whose own employees are exposed to a hazard.

Citations & Penalties • Non-serious - A violation that has a direct relationship to job safety and health, but probably would not cause serious physical harm /or death. (Maximum $7,000, usually none.) • Serious - A violation where there is substantial probability of serious physical harm /or death. (Maximum $7,000)
Citations & Penalties (con’t.) • Willful - A violation where the employer knows of the standards requirements, knows employees are working in violation, and makes no effort to correct the situation. ( Min. 5,000 Max. 70,000 ) • Repeat - A violation for an identical or similar condition that was previously cited within the prior 12 months. (Maximum $70,000)
CITATIONS & PENALTIES (contd.) • Failure to abate - A violation which continues, uncorrected, beyond the prescribed abatement date.
Follow-up Inspections • Verify that the employer did post the citations. • Ensure that all violations have been abated. • Failure to correct apparent violations within the abatement period, could be up to $7000.00 per day for each day the violation has not been corrected up to 30 days.
Compliance Inspections • ADOSH Compliance Officers conduct un-announced safety and health inspections in construction and general industry.
Compliance Inspections • Contact the safety director or the superintendent. • Contact all foreman from each sub contractor. • Show his /or her identification
Compliance Inspections • Conduct an opening conference • Obtain company information • Reason for the inspection • Interview 10% of the employees • Take photographs etc. • Review safety programs
The Walk Around • Representative of the general contractor • Representative of each subcontractor • Union Representative or employee representative
The Walk Around • Inspect the entire facility /jobsite • Inspect all equipment and inspection procedures for such equipment • Document apparent violations • Interview exposed employees
