The state must have procedures to ensure that public comments and concerns on permit determinations are considered
The state must have the authority to collect any information regarding construction or operation
3. EPA REQUIREMENTS FOR STATE ISSUED PERMITS (contd.) All municipal solid waste permits must follow the design considerations under Section 40 of the RCRA Guidelines for Construction and Operation of Solid Waste Landfills. These include:
Groundwater and gas monitoring during construction and operation
Wetland and floodplain (runoff) considerations
Air quality issues
Slope stability
Closure and post-closure standards
Financial assurance standards for municipalities

Public knowledge, consideration and input is still primary concern
Groundwater and gas monitoring as well as runoff and air quality requirements are not as stringent as those for MSW permitting

6. REQUIRED PERMITS Construction Permit
A permit to construct a SWM facility is issued by the NCDENR Division of Waste Management (DWM) after site and construction plans have been approved
Operating Permit
A permit to operate a SWM facility will be issued once the NCDENR DWM has determined that the facility has been constructed in accordance with the construction permit, that any pre-operative conditions of the construction permit have been met, and that the construction permits has been recorded.
7. Miscellaneous Land Clearing and Inert Debris (LCID) Landfills may be issued a combined permit to construct and operate the facility
Permits shall be reviewed every five (5) years.

An approval letter from the unit of local government having zoning authority
Detailed plans and specifications for SWM facilities (except demolition landfills) shall be prepared by a professional engineer
9. Permit to Construct Facility Plan – describes the comprehensive development of the landfill facility
Engineering Plan – prepared for the initial phase of development
Construction Quality Assurance (CQA) Plan
Operation Plan
Closure and Post-Closure Plan
Water quality monitoring plan
10. Permit to Operate Owner or Operator shall meet pre-operative requirements of the Permit to Construct in order to qualify the facility for a Permit to Operate
Amendments to the permit must contain all updated plans submitted with the original application for Permit to Construct
