By the end of today’s lesson, you should be able to: • Describe the roles of the executive branch and identify important executive branch officials • Describe the function and organization of the state judicial branch
Governor = President of the State? • Not exactly, but the President and the Governor do have similar roles • Both are the head of the executive branch • Governors only have domestic power over in-state issues • The President controls domestic issues within the U.S. and foreign affairs
Governor Bob Riley • 52nd Governor of Alabama • Elected in 2002 • Sworn in January 2003 • Republican • Former U.S. Congressman
Roles of the Governor • Chief Executive: Enforce Laws, Commander-in-Chief of the National Guard, Enforce Laws, Appoint Officials, Ceremonial Duties
Legislative Leader: Propose legislation, propose a budget, give a speech the legislator, veto bills Judicial Role: Some governors appoint some judges, reduce or overturn the sentence of someone convicted of a crime Roles of the Governor
State Executive Agencies • Department of Education – sets required number of school days, courses and credits required to graduate, qualifications for teachers • Department of Transportation – maintain state roads, bridges, railroads • Department of Health – Regulates food, provides some immunizations • Department of Revenue – collects state taxes
Executive Officials • Lieutenant Governor: 2nd highest state official and similar to a Vice President • Secretary of State: In charge of the state’s official records and documents, supervises elections • Attorney General: State’s Chief Legal Officer • Treasurer: State’s Chief Financial Officer
State Judicial Branch • State Courts • Protects the rights and freedoms guaranteed by the state constitutions
State & Federal Judicial Branches • Both levels can hear criminal or civil cases • Both levels of the judicial branch can act as a check on other branches • Can declare other branches actions unconstitutional • State courts can only declare state actions unconstitutional • Federal courts can declare both federal and state government actions unconstitutional – JUDICIAL REVIEW
Organization of State Courts • Varies from state to state • Most state court systems have 3 levels • Alabama has state courts in cities, the Alabama Circuit Court of Appeals, and the Alabama Supreme Court
Method of Selecting State Judges • Selected through election, appointment, or some combination of the 2 (Missouri Plan) • Alabama elects states judges except when a vacancy comes up midterm. Then the governor appoints a judge to complete the remainder of the term. • An advantage of electing state judges is that judges are responsible to the voters. • A disadvantage of electing state judges is that judges can be influenced by political pressure.
Federalism in the State Court System • Federal Constitution is still the Supreme Law of the Land • Power is shared by state and federal governments, but a federal court can overrule a state court. • Federal Constitution trumps the state constitutions if the 2 conflict UNLESS the state constitution is giving additional rights.
