Endangered Species Act • Endangered Species Act (ESA) • Passed in 1973 by Nixon • Purpose: • Conserve ecosystems that listed species depend on • Provide a program for conservation of listed species

  6. Endangered Species Act • Endangered Species Act (ESA) • Species cannot be harmed, pursued, hunted, transported or traded • Fish and Wildlife Service = oversight • Other federal agencies also need to comply Blowout Penstemon

ESA Section 7 of the ESA • 7(a)(1) – All Federal agencies shall…carry out programs for the conservation of endangered and threatened species. • 7(a)(2) – All Federal agencies shall…insure that any action authorized, funded, or carried out by such agency is not likely to jeopardize the continued existence of any endangered or threatened species…

  10. Endangered Species Protection Program Goals of the ESPP: • To protect T&E species from the use of pesticides • To minimize the impact of the program on pesticide users Pallid Sturgeon

  11. Pesticides & ES • Facts • DDT and birds of prey • 20% of species are listed, in part, because of pesticide use • Use of carbofuran results in 1-2 million birds deaths/year • Hundreds of pesticide registrations/year &thousands of pesticide active ingredients

  15. Field Implementation • ESPP implemented by: • Adding label statements • Developing county bulletins • Distributing the bulletins • Approving State/Tribal-initiated plans

Label Statements Reference to County Bulletins * Under the Endangered Species Act, it is a Federal offense to use any pesticide in a manner that results in the death of a member of an endangered species. Prior to making applications, the user must determine that endangered species are not located in or immediately adjacent to the site to be treated. Applicators must ensure species protection by following county bulletins, where available. Visit www.epa.gov or call 1800555-5555 to obtain a county bulletin. * Currently not implemented
