  3. Purpose of the Meeting • To provide an overview of the EIA Process to be carried out for this project. • To provide a brief introduction to the proposed project. • For the public to seek clarity on the project. • To record any issues and concerns raised.

The Legal Framework An EIA process is a statutory requirement in terms of: • National Environmental Management Act (ActNo 107 of 1998) • Environment Conservation Act (Act 73 of 1989) and Regulations (4[6]). • SA Constitution Act No 108 of 1996 • S24: Environment • S32: Access to Information • S33: Just Administrative Action The proposed development has been identified as activity 1(d) listed in terms of GNR 1182, which reads as follows: “the construction or upgrading of roads, railways, airfields and associated structures.”

  5. The E.I.A. Aims and Objectives • To assess the impacts of a proposed development on the receiving environment. • Investigates ways to minimise the possible negative impacts while maximising the positive impacts. • Ensure Public Participation throughout the process. There are two phases to the process: The Scoping Phase: Provides information on the proposed project, gathers all issues and concerns raised by interested and affected parties (I&APs) and identifies the possible impacts that the proposed development will have on the receiving environment. The Environmental Impact Phase: Provides a more detailed assessment of the possible impacts on the receiving environment that need to be addressed relating to the issues and concerns raised by I&APs. It also addresses possible measures to minimise or mitigate the negative impacts of the proposed project.

  6. The Scoping Phase The Scoping Phase is a process to determine whether a proposed activity / project requires an environmental assessment, as well as the type and level of the assessment to be undertaken. The Scoping Phase: • Provides I&APs with information on the proposal. • Captures issues and concerns of I&APs. • Provide preliminary response or detailed responses, if available on the issues and concerns that are raised. • Identify feasible alternatives • Identify the possible key environmental impacts that may occur. • Inform the planning process. In terms of the regulations the decision-making rests with the relevant authorities.

  7. Public Participation in the Scoping Phase • I&APs are consulted. • I&APs issues and concerns are recorded and evaluated within the Scoping Report. • Authorities to consider whether issues/concerns are significant and require further assessment. • Review and appeal process by I&APs and/or the applicant and/or another authority.

  8. The Key Role Players The Applicant: The eThekwini Transport Authority & KZN Dept. of Transport • To appoint independent consultants. • Responsible for all costs. • Ensure consultant has no vested interest in the project. • Ensure suitability of the consultant. • Ensure the consultant provides all relevant information to authorities.

The Consultants: Pravin Amar Development Planners & Iliso Consulting • Act on behalf of the applicant (not for). • Be independent with no vested interest. • Have the necessary qualifications and experience. • Produce all processes, information, plans and reports. • Provide all relevant information to the authorities. • Undertake the public participation process.

  10. The Key Role Players……. Interested and Affected Parties • Provide input and comments during various stages in the process. • Identify Issues and possible alternatives • Review of Reports • Provide Input and comment within specific timeframes.

Relevant Environmental Authority • Efficient and expedient in evaluating proposals • Compliance with regulatory requirements • Inter-departmental co-operation and consultation • Consultation with applicant and consultant • Evaluation/review and decision-making • Require only sufficient information to make informed decisions.

  12. The Way Forward Detail of issues and concerns to be included and evaluated in the Environmental Scoping Report. To undertake Specialist Reports where necessary. Detail of potential impacts identified to be included and evaluated in the Scoping Report. Scoping Report will be made available in public places for review. I&APs will be informed of the timeframes for review.
