Definition of murder • The intentional killing of a human being. • Murder has to have Mens Rea, which is the intent to kill someone • Murder also has to have the ActusReas, which is the act of killing someone.
Types of Murder • Type 1: killing with malice • Type 2: intentionally causing great bodily harm that can likely lead to death • Type 3: extreme reckless behavior or depraved heart • Type 4: Felony Murder
What is Felony Murder? • The Felony Murder rule is that if someone dies while you’re committing a felony, you are guilty of murder. • Even if you didn’t personally kill the person or want them to die, you are guilty of murder.
Degrees of murder • 1st Degree: premeditated intentional killing of a human being • 2nd Degree: not premeditated intentional killing of a human being • After the case of Snowden, 2nd Degree murder has been revoked • Now if you are ever guilty of murder, you are guilty of murder to the 1st degree
