USDOT Nurse Tank Transport Regulations Federal HazMat Regulations Federal Motor Carrier Safety Regulations Both Apply to Nurse Tank Vehicle Transportation
USDOT Cargo Tank Regulations • Nurse tanks must meet all conditions of 49 CFR 173.315 (m) or USDOT Special Permit 13554 • Nurse tanks must be marked & placarded as required in part 172
USDOT HazMat Regulations Nurse Tank Requirements 49 CFR 173.315 (m) • Private carrier for exclusive agricultural use • Minimum design pressure 250 psig • Meets ASME code & is marked with legible data plate • Safety relief valves conforming to CGA Pamphlet S-1.2
USDOT Hazmat RegulationsNurse Tank Requirements 49 CFR 173.315 (m) • 3000 gallon capacity maximum • Painted white or aluminum • Loaded to filling density no more than 56% • Securely mounted on farm wagon • Hazmat shipping papers not required • No placards/markings required on one end if valves or fittings prevent it.
Tanks with Missing/Illegible Data Plates are Out-of-Service Options • Tested, inspected & operated under DOT-SP13554 or • Re-plated per National Board/ASME standards Your association has information on both of these options

Nurse Tank Marking • Durable, affixed to surface of tank • Displayed on background of sharply contrasting color • Unobscured by labels or attachments • Located away from other marking

Nurse Tank PLACARDS Maintained by carrier so that format, legibility, color, visibility not substantially reduced
Placard all 4 sides, except nurse tanks need not be placarded on end if valves, fitting, gauges prevent it
Nurse Tank Trailers, and Trucks Towing Them are CMV’s • Nurse Tank Trailers must be inspected, operated, and maintained like any CMV • Drivers must have either a CDL with HM and Tank endorsement or a Seasonal Restricted CDL • Drivers Must be qualified: DOT medical certificate, driver file,
Drivers, Vehicles, & Hazmat Covered by the Uniform Out-of-Service Criteria Drivers, Vehicles, or Tanks placed OOS may not be operated until problem corrected
Interstate or Intrastate Only? Equipment & Driver Requirements Different • Minnesota laws give some exemptions from lighting and brakes for nurse tank vehicles • Federal Motor Carrier Safety Regulation Equipment and Driver Standards Apply to all Interstate Operations • Age requirement for drivers different
Interstate or Intrastate Daily Vehicle Inspections Carrier must require, & driver must prepare a written vehicle inspection report each day vehicle operated • Identify the vehicle • List defects that affect safety of operation or may result in breakdown • Signed by the driver
Interstate or Intrastate Daily Vehicle Inspections Inspection reports must cover: • Tires • Wheel/rims • Brakes • Coupling devices • Lights & reflectors • more
Periodic (Annual) Inspections • INTERSTATE: Both towing unit and trailer • INTRASTATE: Towing Unit (pickup)
Intrastate Only? • Lighting: IF lights on towing unit visible no lights required on NT trailer • Brakes: NT trailers greater than 12,000 gross weight must have brakes • Brakes: All vehicles and combinations must meet brake performance standards in Minnesota Law
Interstate: Does Vehicle Cross State Line? • Lights: on all trailers and trucks as required in 49 CFR 393.9 • Brakes: as required in 49 CFR part 393 subpart C
Nurse Tank Trailers Most Frequent Equipment Violations Discovered • Tank securement devices: missing or loose bolts, cracked fastners or frames • Cracked/broken hitches • Bad tires
Nurse Tank Vehicle DriversAll Drivers • Must be Trained, Tested & Certified Hazmat Employees • Hazmat Employer must have training records and certification • CDL with HME and Tank endorsement or Restricted Seasonal CDL • Meet USDOT Driver Qualification Standards except for age limit
Combination Over 26,000 lbs? Trailer Over 10,000 lbs? Driver Needs Class A CDL with HME & Tank Endorsement
Nurse Tank Vehicle DriversIntrastate ONLY Drivers • Must be at least 18 years of age if: • Hauling fertilizer or ag chemicals DIRECTLY TO A FARM FOR ON-FARM USE within 50 mile radius of retailers location
Nurse Tank Vehicle DriversINTERSTATE Drivers • Must be at least 21 years of age
