Early retirement of workers > 50 years in Luxembourg • Since 1980: Luxembourg supported a policy of early retirement of the old workers through: • early retirement scheme in different activity sector (iron and steel industry) • wish of certain workforce to have an early retirement age. • Until 1996: Easy policy to obtain a disability pension • Consequence: the desire not to work until the legal age of retirement (65 years) is a common attitude for the social partners • Since 2000: deceleration of the economic activity: • gel of recruitment and internal policy to encourage the old workers to leave the company precociously • replacement of these early departures by younger, more flexible, more trained and less paid workers. divsion of occupational health 2006

Legal action to promote employment of old workers • In 1996: more restrictive access to get a disability pension • Incitation for workers to stay longer in activity, especially the last years of career, to get a better pension • Reform of the public function with possibilities of part-time work and promotion of maintenance in activity beyond the legal age of retirement • Refunding of social security costs for 7 years for companies which engaged workers >50 years. • Suppression of the conditions needed to obtain an authorization to work after having an old-age pension • Obligation since 2002 to reclassify workers with reduced capacity of work divsion of occupational health 2006

Law of July 25th 2002 concerning the disability and the professional reintegration • Conditions for workers to benefit from this law: • Workers having an affiliation to the Luxembourg Social Security (12 months during the last 3 years) • Workers in prolonged sick leave (4 months) • Workers having get a refusal of their demand for a disability pension • Workers declared inapt to stay at their last work station by the occupational health physician • Workers having had a withdrawal of their temporary pension divsion of occupational health 2006
Procedure of professional reintegration • Decision maker: • Joint Commission of the ADEM (Administration of employment) • Members of this commission: State, Employers, Trade unions • Joint Commission decides on internal and/or external reclassification on the base of the following elements: • Number of workers with handicap already occupied in the company • Number of workers who got better working conditions after being declared unfit by the occupational health physician • Opinion of the employer • Opinion of the occupational health physician of the company and of the administration of employment divsion of occupational health 2006
Reclassification • Internal reclassification: • Assignment at another work station and/or organization of work (ex: reducing hours), and/or better working conditions • Can be refused if the employer has lesser than 25 employees, or if the employer have not the quota stated by law of workers with an handicap • External reclassification: • For employer with lesser than 25 employees, or if the employer have the quota stated by law of workers with an handicap • For employer who have no adapted post to continue to employ the worker with incapacity • Workers are apply for unemployment benefit during 1,5 year max. • Without reclassification on the labour market after the end of unemployment, pension paid by the Fund for Employmentuntil the worker reached the legal age for pension. divsion of occupational health 2006

Conclusion • Very high foreign labour force and cross border workers • Low rate activity for old workers in Luxembourg • Statistics concerning the health of old workers can be realised easily by the occupational health services • Since 1996 promotion of employment of old workers done by the authorities • Implementation of legal actions to promote employment of old workers as for example: reclassification of workers with reduced capacity of work divsion of occupational health 2006
