Communication • Prior to this afternoon's hearing, EPD met with Commissioner Boyd’s staff to review the staff report and recommendation that is found in your agenda packet.

Variances • The applicant is also requesting the following variances: • Section 15-605(b)(3) (companion dock). “In order to prevent boat prop scouring and littoral zone damage, no boat ramp facility, except for a private boat ramp facility, shall be permitted unless built in conjunction with a companion boat mooring dock.” • The site has already has a boat dock in place that performs the function of the companion dock.
Variances Section 15-605(b)(14)(d) (letter of credit) “…require the applicant to post a one-year irrevocable letter of credit, in favor of Orange County, in the amount of ten (10) percent of the assessed value of the boat ramp facility site in favor of Orange County to secure the foregoing costs….” The applicant has requested that they be able to post a one-year irrevocable letter of credit, in favor of Orange County, in the amount of one hundred and ten (110) percent of the cost of the boat ramp facility. Vista del Lago is one large parcel (285 acres with 925 homes) not parceled out as a typical subdivision.
Variances Section 15-605(b)(23) “Landscaping, screen walls and any other available measures to reduce noise impacts shall be a part of the design of all boat ramp facilities.” The development is replacing an existing ramp which has been was installed during the inception of the community. There are landscaping measures adjacent to the residence nearest the boat ramp. No additional measures are being proposed.
Action Requested • ACTION REQUESTED: • Approval of the boat ramp permit and variances to Section 15-605(b)(3), 15-605(b)(14)(d), and 15-605(b)(23) contingent upon an original executed letter of credit being submitted in a form approved by EPD, and acceptance of the Developer’s Agreement and authorization to record instrument subject to the conditions listed in the staff report.
