Proposed Revisions to40 CFR part 51 (public hearings) Revising 40 CFR 51.102(a) and (f), 51.103(a) public hearing/copy requirements (currently in signature chain). Current regulation as written requires states to hold public hearings for revisions to state implementation plans. Many of these plan revisions are minor or noncontroversial in nature.
Proposed Revisions to40 CFR part 51 (public hearings) • These hearings consume both valuable time and resources. • Rather than requiring a public hearing for all SIP revisions, the proposed revision will allow states to provide the public the opportunity to request a public hearing. • If no request for a public hearing is received then the public hearing may be cancelled.
Proposed Revisions to40 CFR part 51 (number of copies) • Current regulation requires states to submit 5 copies of each proposed revision. • Submittals range in size. • Rather than require 5 copies the proposed revision will require at least 2 copies and an electronic copy.
Proposed Revisions to40 CFR part 51 • Revising 40 CFR 51.102(d) prominent advertisement in the area affected (currently being drafted). • EPA intends to clarify the term “prominent advertisement”. • View of “prominent advertisement” will include the internet, State Register or local newspapers.
