THE SETTLEMENT • Happened on 8th May 2012 • Involves: • Cash redress • Cultural redress properties • Commercial redress properties • Mohaka Forest • Kaitiakitanga
CASH REDRESS Settlement sum $ 7,953,000.00 Interest $ 1,739,140.10 Mohaka Forest Rentals (from Crown Forest Rental Trust) $15,904,586.10 Total $25,596,726.10
Of that $25,596,726.10 • $25,000,000.00 is on term deposits through BNZ • $565,319.44 used to repay ASB mortgage on Chimney Creek
CASH ASSETS The Trustees have been advised that the best thing for now is to make sure the cash is: • invested safely (spreading the risk – several banks/different terms); and • left alone, while longer term strategies are worked out. The Trustees have engaged an independent consultant, Michael Chamberlain to help them work out those strategies.
CULTURAL REDRESS PROPERTIES New titles have been created in the name of the Tiaki Trust for: Tauwhareroa Kuwatawata Ngakoauau A Paaka Te Ahu Rotongaio Rotoroa Ngakoauau B Mangawharangi Tanga Kakariki Putere Raupunga Reserve Takauere Ononi Te Kuta
COMMERCIAL REDRESS PROPERTIES Titles to these properties have been created/transferred to the Development Trust by OTS: Rawhiti Station Vacant section SH2, Raupunga Residential Section (x2) SH2, Raupunga Residential Section, Waihua These ones ex Wairoa District Council: Mohaka Pound site Kotemaori site (ex DOC) Raupunga Stock resting site Mohaka Coach Rd site Putere Rd site
COMMERCIAL REDRESS PROPERTIES Kotemaori site (ex LINZ) will be transferred next week Waipapa B3 (Mohaka) still in progress The Trust is working with Wairoa District Council to identify other sites for transfer
RAWHITI • “Handover” inspection has been done with OTS. • OTS will pay for a “tidy up”. • Tenders for lease of the property have been invited from 1 June.
OTHER COMMERCIAL REDRESS PROPERTIES • OTS will pay for a tidy up. • Trust will organise a local crew to carry out some of the work. • Mana Whenua have been engaged to give advice about future potential for the commercial properties. • Scoping study includes lands returned in the settlement and will explore opportunities for development of whanau lands.
MOHAKA FOREST • Rent has been set for next 3 years @ $825,000.00 yearly • Joint access protocol has been put in place with Pan Pac • Negotiations are underway for: • replanting (or not) after 30 September 2012 • future relationship with Pan Pac • future opportunities for Ngati Pahauwera – including business and employment opportunities
MOHAKA FOREST (Carbon Credits) • A Holding Account has been opened for the NZU's. • Units have been transferred to that account. • Submissions will be filed opposing proposed changes to the ETS which would mean we don't receive the second instalment of credits.
KAITIAKITANGA • Joint Planning Committee with HB Regional Council has been created (Toro is the Ngati Pahauwera delegate) • Met with Wairoa DC and working on formal procedure for Ngati Pahauwera approval of Resource Consent applications in the core area of interest. • Draft Plan has been prepared for $2m River Protection protocol • Policies are being developed for gravel extraction (and sale?)
STRUCTURE The Trustees have updated tax advice that suggests: • A Development Company is set up for the Trust's Commercial activities (this has been done) - Ngati Pahauwera Commercial Development Limited. • The Tiaki Trust stays as a Whare Taonga – to hold properties and not used to deal with income from the Development Trust. • A new Charitable Trust (operated by the Trustees) is set up to carry out the non-profit objectives of the Development Trust. That Trust (Ngati Pahauwera Manaaki Trust) is being set up now.
TAKUTAI MOANA The Trustees recently met with the Minister to resume negotiations. The agreed process is: • The Trustees will engage in these negotiations with the Crown on behalf of Ngati Pahauwera. • The Crown will provide funding to enable Ngati Pahauwera to fully engage in the negotiations. Quantum to be fixed. • Both parties will begin by reviewing the evidence already given to the Maori Land Court about Customary Title.
TAKUTAI MOANA • Under the Foreshore and Seabed Act, we had trouble meeting the tests for Customary Marine Title because of the requirement that we continuously held foreshore land. That is no longer a requirement. • There will be another meeting with the Crown on 21 May to look at the funding and whether, after looking at the Maori Land Court information, the Crown will acknowledge that tests for protected customary rights and Customary Marine Title are met.
CROWN APOLOGY • The Minister would like to come to Mohaka soon to make the formal apology and receive the gift of Te Heru O Tureia. • The Trustees have taken the view that: • The apology should represent “closure” and is premature until other grievance issues are resolved eg: • Takutai Moana • Awa Management. • There should be no formal “gift” of Te Heru O Tureia to the Crown.
OTHER CROWN ISSUES • Submissions have been filed opposing the partial sale of State Owned Assets • Submissions will be filed opposing proposed changes to ETS • Dealing with other issues as they arise
ELECTIONS • Next week nominations will be called for. Other important dates are: • 6th June – nominations close • 16 June – notice of election and election packs sent out • 19 June – voting opens • 20 July – voting closes • There are policies about Trustee remuneration and expectations of Trustees/job description on the website • Members will be asked if online voting is OK in the future
