Did you know??? • The following County regulations are currently in effect in the Town of Bridge Creek: • Sanitary – Title 8, Chapter 8.12 • Uniform Dwelling Code (new construction) – Title 15 • Commercial Building Code – Title 15 • Manure Storage – Title 17, Chapter 17.04 • Erosion control and storm water – Title 17, Chapter 17.05 • Shoreland Overlay District – Title 18, Chapter 18.19 • Floodplain Overlay District – Title 18, Chapter 18.20 • Wellhead Protection – Title 18, Chapter 18.55 • Subdivision – Title 18, Chapters 18.76 – 18.85 • Nonmetallic Mining Reclamation – Title 18, Chapter 18.90 – 18.97

  4. Current conditions: • Town of Bridge Creek: • 55.3% (35,630.2 acres) is unzoned. • 44.7% (28,835.6 acres) of the town is subject to shoreland overlay zoning.

  5. Taking a closer look! • Town of Bridge Creek • 39.4 % (25,417.9 acres) is municipally owned property (State, County, City, Town). • 36.7% (23,673.7 acres) of the town unzoned. • 23.8% (15,374.3 acres) of the town is in the shoreland overlay district (subject to zoning).

The Basics • Zoning is a common method of land use controls used by local governments. • Local governments chose to have general zoning as one tool to achieve community goals: • Promote public health, safety, comfort, convenience and general welfare of the citizens; • Protect and conserve natural resources; • Protect and conserve the social character and economic stability and preserve property values; • Protect agricultural resources.

  7. What’s in a zoning ordinance? • Two main components: • Ordinance text • Zoning map

  8. Zoning Map • Divides the community into zoning districts, such as: • Agricultural • Residential • Commercial • Industrial • Forestry • Properly cited districts will help achieve orderly growth and development within a community, and will separate incompatible land use from one another.

Zoning Ordinance (Text) • The text of the zoning ordinance spells out rules that apply to each zone. • Most ordinances contain the following: • Title, Authority and Purpose • General Provisions • Zoning Districts and Regulations • Nonconforming Uses, Structures and Lots • Impact Standards: Parking, Landscaping, Signage, etc. • Administration and Enforcement

Purpose of zoning • Eau Claire County’s Zoning Code: Purpose (Section 18.01.010) It shall be the purpose of this subtitle, through the regulation of the use of lands and structures, through the establishment of physical standards, through the creation of separate zoning districts and through the mechanisms provided herein for enforcement and administration.

Zoning Districts and Regulations • This part of the code contains the zoning districts. • The districts typically allow the following types of uses: • Permitted and accessory uses • Conditional uses • Each zoning district contains a set of rules that apply to land in that district. • Density regulations (number of uses, lot size) • Dimensional regulations (height, setbacks)

Nonconforming Uses, Structures and Lots • When zoning is adopted, some existing uses, structures, and lots may not conform with the ordinance guidelines. • Nonconforming uses/structures are generally allowed to continue. “Grandfathering” • If the nonconforming use is discontinued for a period of 12 months, it shall be considered abandoned.

Administrative and Enforcement • Administrative: • Duties of the Department of Planning and Development • Oversight Committee: Committee on Planning and Development • Conducts public hearings on zoning matters, conditional use requests, rezone petitions, and comprehensive plan amendments • Board of Land Use Appeals – Hears and decides administrative appeals and variance requests. • Site plan approval • Permit issuance • Amending the zoning code • Enforcement • Investigate complaints • Issue notices of violation • Corporation Counsel assists with legal matters
