SNSA’s Political Independence • SNSA is independent in its professional decisions • Licensees may appeal to the Ministry however • New law prevents appeals to some decisions
SNSA: No Appeals Possible • Prohibition of or temporary suspension of the use of a radiation source (art. 13) • Rejection or acceptance of an evaluation of the protection of exposed workers against radiation. (art. 26) • Rejection or acceptance of an approval for the commencement of a trial operation. (art. 78) • Periodic safety review (art. 81) • Rejection or approval of the proposed changes significant for radiation or nuclear safety. (art. 84) (FSAR) • Withdrawal of the licence (art. 116) • Expiry of the licence (art. 117)
Legislative Aspects • SNSA is defined in the new Nuclear Safety Law (article 138.) • Also defined in the Governmental Decree on the Organisation of the Governmental Bodies (in government procedure, adopted in January 2003 - in accordance with Public Administration Bill, art. 41.)
