What is Excavation ??? • Excavation is defined in the state law as any means of operation in which earth is moved or removed by means of any tool, equipment, or explosives and includes auguring, backfilling, boring, ditching, grading, plowing-in, pulling-in, ripping, scraping, trenching and tunneling.
What Can WE Do? Change OUR Attitudes . . . Change OUR Habits . . . Communicate . . . Coordinate . . . Cooperate . . .
Too Many Damages! • We all have Reasons damages occur • We all are given Mandates from above • We all face Obstacles in the field BUT . . . • 65% of damages AT LEAST had a locate requested! • And 54% AT LEAST had a locate performed! MOST are trying to do what is right! Can WE DO MORE?
A Few Points about Locate Requests and Marks • REQUEST separate locates (Get your own) • Locate marks EXPIRE 30 days after laid down or until no longer visible • Maintain YOUR Documentation! Request#, sketches, measurements, pictures • Excavator NOTIFY UNCC and facility owner (immediately) if underground facility is damaged • Facility owner REPORT damage within 90 days • CALL 911FIRSTwhen appropriate
Civil Fines-when locate NOT requested- • Penalty for not calling is $200 • If a facility is damaged and locate NOT requested, penalties are as follows: • $5,000 for the first offense • Up to $25,000 for each subsequent event in a 12-month period • Up to $75,000 for more than three in a 12-month period
Second Notice Request • Excavator requests and UNCC re-notifies member facilities when • Some or all scheduled meets not kept • Some or all facility locates not complete by due date • Some or all markings are inaccurate • Some or all markings are not complete • Specify which member facilities need to respond • Request must be processed within 5 business days from due date of original ticket • Law permits “Proceed with caution and care” after 2nd notice – not liable for damage
Relocate/Refresh • Excavator requests and UNCC re-notifies member facilities when • Marks are no longer clearly visible • Facility owner must respond as soon as practical • Specify which member facilities need to respond • Request must be processed within 5 business days from due date of original ticket • Original locate instructions must remain the same
Reasonable Care Standard Excavator • Requires excavators use reasonable care when excavating around marked facilities • The following are acceptable methods of verifying facility and excavating within 18 inches from either side of facility. • Visual verification of the facility • Pot Holing to visually verify facility • Vacuum Excavation • Use of non-mechanized excavation tools • Hand digging with reasonable care
Tolerance Zone is the area 18” from the outside dimensions in allhorizontaldirections of an underground facility (reasonable care required). (18 inches) (18 inches)
Locate Documentation • Excavator must maintain documentation regarding locate at the excavation site • Documentation includes but is not limited to: • UNCC Ticket Number • Locator Sketch if provided • Excavator Sketch • Photographs • Video • Positive Response – All Clear

Reasonable Care Standard Facility Owner • Requires owners/operators to use reasonable care to respond and mark their facilities • Reasonable care includes: • Marking accurately within 18” • Marking within 3 business days • Mark with paint, flags, whiskers • Appropriate color (APWA Code)
Identification of Abandoned Facilities • Requires the identification of abandoned facilities in the proposed excavation area • Facilities abandoned after January 1, 2001 • Marked “if known” • Excavator should treat all abandoned facilities as live

Damage Reporting • Excavator MUST CALL UNCC and report ALL facility damages immediately! ( Please call 911 first, if needed) • Facility owner is required to report ALL facility damages to UNCC within 90 days of damage • Statistical data made available to all stakeholders to help with damage prevention efforts • Report is available on website: www.uncc.org
