  3. Roanne – the impact (2) • Rethinking existing schemes • Extending application of public procurement process • Delays • Increased costs • All exacerbated by current climate • Are professional advisers helping?

  4. Roanne – what should we do? • The prospect of challenge (from EU or elsewhere makes Councils nervous) • Councils need re-assurance/guidance • This is a job for central Government (CLG and/or OGC) • In the longer term, should we take on the EC? • Need European allies!

  5. A quick fix! Guidance that: • Spells out where LA/developer partnership might require OJEU tender process. • Makes clear that existence of only one credible partner obviates need for OJEU etc. • Allows disproportionate bidding costs as a rationale for no OJEU etc. • Offers support and advice – not complete acquiescence
