Laws -Title VII of the Civil Rights Law of 1964 -Equal Pay Act of 1963 -Age Discrimination and Employment Act of 1967 -Titles I & V of the ADA of 1990 -Section 501 and 505 of the Rehabilitation Act of 1973 -Civil Rights Act of 1991 Summary -No discrimination based on race, color religion, sex, or national origin -equal pay for men and women performing the same job responsibilities -protects individuals older 40 and up -prohibits discrimination of individuals with disabilities in the private/public sectors in state and local governments -prohibits discrimination of individuals with disabilities in federal government -provides monetary damages in cases of intentional employment discrimination LAWS PROHIBITING JOB DISCRIMINATION INCLUDE

Structure & Operations • Consists of 5 commissioners who make equal employment opportunity policy and approve most litigation • 5 year staggered terms by the current President of the U.S.A.; confirmed by the U.S. Senate • The President designates a Chair and the Vice Chair (Chair=CEO) • A general council (appt. every 4 yrs.)also appointed by the President directs litigation throughout the country • Noteworthy: FDR Jr. was the nation’s first EEOC chair Current chair: Ronald Cooper Nominated by George W. Bush

  4. Statistics!WOW! • the agency logged 79,000 complaints in 2004 and more than 75,000 in 2005 • The backlog of complaints rose from 33,562 in 2005 to 39,061 in 2006. (cases that have not been litigated) the projected numbers for 2007 are 47,500 • The budget for 2006 is slated to be $327 million

  5. How EEOC works differently in the field of education! NO DIFFERENCE!!!!!!!! Employers (including school systems) are required to post notices to all employees advising them of their rights under the laws EEOC enforces and their right to be free from retaliation. Such notices must be accessible, as needed, to persons with visual or others disabilities that effect reading. Note: many states and municipalities also have enacted protections against discrimination and harassment based on sexual orientation, status as a parent, marital status and political affiliation.
