Main aspects to check During tender evaluation, there are several aspects to be specifically checked for compliance with the TD requirements. Beside compliance with Technical Specifications such aspects may make a significant difference for the successful contract implementation. Any such apparently minor aspect, may later be exploited by the Contractor for reducing his responsibilities
Main aspects to check- delivery conditions and schedule - Evaluators must check if: • the right place of delivery is indicated in the offer. • delivery risks assumed by Tenderer. • packaging/ labelling requirements are observed. • correct delivery schedule and location(s) • DDP or DDU • unloading considered • other such requirements • installation and testing included
Main aspects to check- training and manuals - Evaluators must check if: • the requested training of staff is included. • included training comprise the requested number of Beneficiry staff (e.g. some Tenderers may propose to train a limited number of staff that will later train the others). • the requeste users’ manuals are provided • if manuals are provided in the requested language • other such requirements
Main aspects to check- spare parts and after-sales service - Evaluators must check if: • the requested spare parts are included. • included spare parts are in the right quantity, or for the right period. • if spare parts are to be the subject of another contract, there are no “hidden” provisions in the offer for later modifying the spare parts price. • after-sales services are included in the offer as requested in the TD. • Warranty period is provided as requested in TD
Main aspects to check- observance of Conditions of Contract - Evaluators must check if: • there are no provisions that may alter the Conditions of Contract, “hidden” in the offer. • such provision may target applicable law, delivery conditions and schedule, payments, Contractor’s obligations, warranty, spare parts, training, after-sales services, etc. A safeguarding paragraph should be included in TD, indicating that any provision in the offers, contradicting the TD requirements, is null and void.
Main aspects to check When assessing an offer, one must not automatically consider all Tenderers as fraudulent in intention. An eventual such mismatch, may simply be a mistake and is not necessary the proof of a fraud. Such cases will be carefully treated and clarifications will be sought. If punishment (offer rejection) is decided, there must be a “rock solid” justification that can not be eventually dismantled in court.
