Purpose of Today • To inform on the Retrospective Checking Policy for Paid Sector To provide information on paid sector policy • To access the views of the Voluntary Sector To consult and inform on proposals to manage the required Retrospective Checking within the voluntary sector • To plan a Retrospective Policy for the Voluntary Sector To assist in the development of a suitable and manageable Policy for the voluntary sector and inform on proposals to control Retrospective Checking within both the Paid and Voluntary Sectors

Who is covered by a Retrospective Check • “All current employees/volunteers whose duties/roles fall into the definition of ‘Regulated Work’ under PVG, whether or not they have previously been issued with an Enhanced or Standard Disclosure Certificate” However, anybody who is being recruited by or promoted within an organisation into a ‘Regulated Work’ position will NOT fall into the Retrospective Checking regime. They will be subject to the Scheme Membership process on their recruitment/promotion.

Examples • A person applying for, and being recruited, as a volunteer church creche worker will be subject to the Scheme Membership process on recruitment. however • A person, who is already in post as a volunteer church creche worker, will fall into the Retrospective Checking regime and the Scheme Membership process should only be actioned in accordance with the Retrospective Checking Policy.

  5. Retrospection TimescalePaid Sector From Introduction of PVG • Year 1 - No Retrospection, newly appointed/promoted only • Year 2 - Retrospection (plus newly appointed/promoted) • Year 3 - Retrospection (plus newly appointed/promoted) • Year 4 - Retrospection (plus newly appointed/promoted) • Year 5 - Applications as required by employers.

Volume AllocationPaid Sector • All Registered Bodies will outline the total number of personnel within the Retrospective Checking Profile • Registered Bodies and Disclosure Scotland will agree a monthly volume of submission for each Registered Body over a 36 month period • Registered Bodies will not submit over the agreed amount in a monthly period • Disclosure Scotland will not accept applications over the agreed monthly volume

  7. Disclosure Scotland Volumes • Registered Bodies 3,100 • Applications processed per year 860,600 • CRBS Applications per year 56,000 • 80% of Disclosure Scotland’s Enhanced Applications are carried out by 10% of the Registered Bodies

Questions for Voluntary Sector • What is the view of the Paid Sector Policy? • What are the issues for the Voluntary Sector? • Can the Voluntary Sector identify volumes for Retrospective Checking? • When does the Voluntary Sector think a Retrospection Policy should be introduced to the Voluntary Sector?

  9. Next Steps • Disclosure Scotland will consult with other stakeholders including the CRBS • Policy will be developed for April 2010 • Service Level Agreements will be progressed with CRBS regarding the Retrospection Policy for the Voluntary Sector
