The Legislative Branch The United States Legislative Branch is called Congress • Congress meets on the third day of January on every odd year • So they would meet on January 3rd of 2011, not January 3rd of 2010 • The House of Representatives and the Senate make up Congress • They both meet in the U.S. Capitol Building burris.senate.gov

  3. Major Jobs • They have the right to declare war • So we can only go to war if the Legislative Branch says it’s ok • To make our country’s laws • To make the law an actual law you need to have at least one over half of the vote. For example if there is 60 people then 31 or more need to agree in order to make it a law

  4. House of Representatives • There are 435 member of the House • The number of members is based on the population of the state • There is one member from one state that stands for 500,000 people of that state. For example if there is 1 million people then 2 members would represent that state • There are 8 members from Wisconsin • The term of office, or how long they get to be in the house is two years • Every two years there is an election, in order to stay in office they need to be re-elected by the people treehugger.com

Requirements to be Elected House of Representatives • At least 25 years of age • Must have been a citizen of the United States for at the very least seven years • You have lived In the U.S. for over seven years and are a legal U.S. citizen • They must also live in the state he/she is representing • So if you are representing Wisconsin you need to live in Wisconsin and no other state.

Presiding Officer for House • The Presiding Officer is also known as the Speaker of the House • Nancy Pelosi is the Presiding Officer for the House • She belongs to the Democratic party • She is the first female Speaker of the U.S. House of Representatives Nancy Pelosi projects.washingtonpost.com

  8. The Senate • Currently the U.S. has 100 senators • Each state sends 2 senators no matter how big the state is or how small the population is in the state • Wisconsin sends 2 Senators just like every other state in the U.S.

  10. Qualifications to be a Senator • At least 30 years of age • A U.S. citizen for 9 years • And live in the state that you are representing

Term for Senate • A senator has a term for six years • But every 2 years 2/3 of the Senate is up for re-election • For example if 33 are elected for a 6 year term then in 2 years 33 others will be elected and in another two years 34 will be elected • They do this so that there is not a totally new group there is always some old Senators to help the new ones

Presiding Officers for Senate • Joe Biden is 1 of the Presiding Officers for Senate, he is the Vice President of the U.S. • Biden is a Democrat and as a kid was teased by his classmates • Daniel K. Inouye is the other presiding officer for the Senate, he is the U.S. Senator for Hawaii • Inouye is a Democrat and when the Japanese attacked Pearl Harbor he stayed there for a week and helped the injured

Impeachment • To impeach is to accuse a member of some wrongdoing or misuse of power • The House is the accuser and the Senate is the jury • The Senate decides if that member is guilty or innocent • 2/3 of the Senate must think that he/she is guilty in order for that person to be removed from office

Bill to Law • First a representative thinks of an idea • Next the idea turns into a bill • After that the bill goes to the committee of the House • Then one over half has to agree to pass it on this is called a Quorum • It then goes to the committee of the Senate • Then one over half has to agree for the Senate Quorum • After that the bill goes to the House and Senate committee • Then it goes to the president • The president then either agrees and makes it a law or vetoes it • Iif he vetoes it then it is sent back to the House Quorum if they want to overwrite it then 2/3 of the House has to agree • If they agree then it goes to the Senate Quorum and then 2/3 of the Senate has to agree • If they both agree then it becomes law without the president ok

  15. 4 Powers of Congress • The power of naturalization (the power to become a U.S. citizen • The power to borrow money when needed • The power to commerce (the power to trade) • Power to tax U.S. citizens

Limits on Congress • They could not make any laws outlawing the slave rate until 1808 • They also have to let the people be seen and heard in a court room this is technically called habeas corpus • Another limitation is the Congress cannot pass an ex post facto law or they can’t punish someone for a crime that they did before it was made law • The Congress also can’t declare someone king or duchesses • They also can’t tax products from a state

  17. Other Powers • Delegated powers are powers that are given to the government in Washington D.C. (United States capital) • For example the power to declare war • Concurrent powers are powers that that are shared between the national and state government • For example the power to tax • Reserved powers are the powers that only the state government has • For example the power to create a school system

My Opinion on the Legislative Branch • Yes I would like to be part of this branch • I would like to be part because I like to make decisions and I am very good at persuading and arguing • A law that I would change would be No Smoking in ANY Public Places • I would change this because as a fact more people die from second-hand smoke (when someone is around someone that smokes and they breath in the smoke) than the actual smoker

Why the Legislative Branch is Important • It is important because if we didn’t have this branch then we wouldn’t have any laws and if we didn’t have any laws then it would be a very unsafe and reckless world • It impacts my life by keeping me safe and able to have a lawful and sophisticated life on Earth
