Ministry of Labour Dispute Resolution Services • The Labour Relations Act, 1995, subsection 57(1): • An employers’ organization and either a trade union or a council of trade unions may enter into a collective agreement; • Such a collective agreement is binding on each employer who is a member of the employers’ organization at the time the collective agreement is entered into and on whose behalf the employers’ organization bargained; • Such a collective agreement is also binding on the employees in the bargaining unit defined in the collective agreement; • After such a collective agreement has been entered into, if an employer ceases to be a member of the employers’ organization during the term of operation of the collective agreement, that employer is deemed to be party to a like agreement for the remainder of the term of operation of the agreement.
