Introduction • Kenya’s Regulatory Framework • National Communications Secretariat (NCS) • Created under the Information & Communications Ministry • Responsible for spelling out Government policy on ICT matters • Is in the final stages of releasing a new ICT policy
Introduction • Kenya’s Regulatory Framework (cnt.) • Communications Commission of Kenya • Independent regulatory Agency [Head appointed by the Minister] • Responsible for Regulating Telecommunication and Postal sectors • Manages Radio-frequency spectrum • Does not regulate broadcast and related media
Introduction • Kenya’s Regulatory Framework (cnt.) • Communications Appeals Tribunal • Handles appeals against regulatory decisions on Telecom and Postal matters • Financed by the Regulator
Introduction [cont.] • Current Status of Market • Government still owns Telco, the Public Postal Licensee and owns 60% of one of two mobile operators through the Telco’s shareholding • Competition introduced in all market segments • Market Structure comprising of: • Facilities and Services providers (Local, Long distance and International voice and data) • Service Providers (ISPs, Value-Added Services providers) • VSAT operators (i.e. not technology-neutral)
Challenges of Convergence • Like other countries, Kenya faces the same challenges posed by convergence • In Kenya, most challenges have emanated from the capabilities of the Internet [mainly VoIP] and Terminal equipment. • Players licensed prior to the advent of convergence demanding enforcement based on conditions in those licences
Challenges of Convergence (cnt) • In Kenya, competition was introduced before privatization of incumbent • Telkom Kenya seems unable to compete effectively • Tendency for Government to protect Incumbent because of its stake in the business • Delays in undertaking necessary policy reviews (i.e maintaining status quo) • Interference with the regulatory process
Challenges of Convergence (cnt) • Broadcast Licensing • Done by the Government • Regulator deals with frequency management aspects of broadcasting • Content regulation a responsibility of the government and media owners’ association • Very little coaxial cable in place
Challenges of Convergence (cnt) • Convergence & Universal Access • Convergence provides an opportunity deploy one type of infrastructure to deliver multiple services to disadvantaged people • Need to find ways of taking full advantage of convergence to deliver the most to consumers
Initiatives to Address Convergence • In the process of Introducing a new market structure featuring: • Network Facilities Provider (NFP) • who shall own and operate any form of communications infrastructure (based on satellite, terrestrial, mobile or fixed)
Initiatives to Address Convergence (cnt) • Applications Service Provider (ASP) • to provide all forms of services to end users using the network services of a facilities provider • Content Services Provider (CSP) • to provide contents services such as broadcast (TV&Radio) material, and other information services and data processing services etc.
Initiatives to Address Convergence (cnt) • Further consultations with stakeholders in progress • Means of phasing in new structure being considered as well • Bill on a converged regulator has been under cabinet consideration for some time now – May be presented to parliament any time
