  3. Problem Does apple winning this court case stifle the industry or force innovation?

  4. Stake holders Consumers • The decision will provide consumers with more certainty about quality, features and operating systems of smartphones they purchase. Smartphone Manufacturers • The decision will force Samsung, HTC, and others to be more creative in order to avoid patent infringement. Apple • The decision provides legal precedent for Apple to take patent infringement action against those relying on the  Android operating system. Samsung • The decision prevents Samsung from selling eight smartphones in the US which are essentially iPhone clones.

  5. Stake holders Google (Motorola) • The decision will force Google and Motorola to be more innovative in ways that do not risk infringement on Apple’s patents. Smartphone Developers • The decision forces Google and Android operating system developers to evolve, rather than copy Apple iPhone interface and features. Smartphone Accessory Providers • The decision will encourage accessory providers to demand Smartphone manufacturers create unique products they can provide accessories for. Smartphone Service Providers • The decision will eventually provide more quality products for cellular service providers, ancillary Internet and brick and mortar retail business.

History • 1992 the first smart phone was introduced (IBM SIMON) • Other phones that were introduced in the early 90’s were Symbian (BlackBerry) and Windows Mobile. • In 2007 Apple introduced the iPhone (said to by 5 years ahead of the competition) • By 2008 apple had 13% of market sales • December 2008 Microsoft ends their phone production

History • 2010 competitors started to have phones with touch screens very similar to Apple’s iPhone • 2010 apple started making lawsuits against Taiwan's HTC • 2011 Google’s Android was 50% of the market • Once android devices were the dominant devices Apple started to pursue its main competitors in court cases of patent infringement.

  12. Economic • Copying is done by many countries • Apple is no longer the top seller in terms of units sold (for 1st quarter 2012) • America is the first battle apple Has won • Job loss for Samsung and allies, growth for Apple

Competitave factors • Apple's products will be a reference to high quality and innovative design. • Opportunities for Microsoft to produce more windows phones (Samsung phones off the market will create a shortage of phones) • Android hardware makers forced to diversify production(build devices for other Operating systems, not just Android) • Cell phone carriers using Samsung's products will be inclined to build new partnerships (if unable to provide same quality phones to customers, they might lose clientele) • Opportunities for Google, RIM, and LG to join forces

  15. Pros and cons • Pros: • Apple products will be a standard of quality to work towards rather than clone • Apple will regain lost ground in the mobile device industry • Apple can defend its patents from other companies

Recomendations The decision reaffirms the value we place as a society on intellectual property rights - rights to exclusive control of our property and the rights to receive just compensation for use of our original creations by others.    Therefore we recommend the following: • We recommend that the patent infringement decision in favor of Apple stand. • We deem the judgment to be fair and that the appeal by Samsung be denied. • We recommend that Samsung focus on innovation as a means to competition.   • We deem that the decision provides the impetus to protect future new products. • We recommend the International community look at this decision as a template.
