I am a Board Member of the Mystery Shopping Professional's Association, having worked in the industry for many years. I would like to discuss Congressman Diaz Balart potentially providing support for a new harmonization bill for labor. Harmonization means the same test across all federal agencies utilizing the current IRS test. Our work is conducted by mystery shoppers who are all independent contractors. There are many different tests that currently define someone's status as either an employee or an independent contractor. Our industry could suffer from incorrect definitions for our mystery shoppers as employees. A harmonized definition of “employee” would be beneficial to all stakeholders. It would provide much needed certainty to independent entrepreneurs and their clients, while also enabling government agencies to more efficiently ensure proper worker classification. For the mystery shopping industry, it is essential that mystery shoppers are recognized as independent, to ensure that the data and findings they report are reliable and objective, and not influenced by the firm that engages them. I would welcome the opportunity of a meeting so I may explain the importance of this harmonization bill.
