Basic Challenges of NJRS • Strengthening of court independency: transfer of greater competences to High Court Council and establishment of Administrative Office • Strengthening of prosecutors autonomy: establishment of State Prosecutorial Council and AO • Criteria for evaluation of judges and prosecutors work and open system of election, promotion, discipline and removal from office establishment • Rationalization of court network • Modernization of infrastructure and equipment Ministry of Justice
Basic Challenges of NJRS • Effective statistic and case management system development and installation in all courts and prosecutor offices • Transformation of JTC into National Judicial Training Institute, with comprehensive and obligatory program • Effective use of Judicial and Prosecutorial Resources, fight against organized crime, trials for war crimes • Improvement of legal framework and harmonization of Serbian legislation with CoE Recommendations and Acquis Communauarie Ministry of Justice
Identified Projects • Project Proposal: “Support to the High Court Council and Administrative Office and the State Public Prosecutorial Council” aims to establish the High Court Council and AO and State Public Prosecutorial Council and AO. Development of criteria • Project Proposal: “Strengthening of Budgetary Independence and Court Administration". High Court Council assumes authority for the preparation of the judiciary’s budget and new judicial professions that will enable more efficient management of court administration • Project Proposal: “Improvement of Efficiency and Transparency of Judiciary System”, establishment of the national IT network for public prosecutorial offices and penalty system that will provide clear and reliable data Ministry of Justice
Identified Projects • Project Proposal: “Establishment of professional mutual legal assistance”, aims to provide more efficient international legal assistance and ensure better law enforcement; creation of comprehensive database. The legal reference database represents up-to-date resource for judges, prosecutors and government officials. • IPA Project proposal: “Capacity building of Judiciary for providing support to system of victim/witness protection in criminal cases”; aims to ensure efficient and successful fight against organized crime groups and facing with consequences of war crimes through strengthening capacity of specialized prosecutorial office. Project will stimulate regional cooperation in this area. Ministry of Justice
Basic Challenges of Fight Against Corruption Strategy • Establishment of Independent body for fight against corruption • IPA Project Proposal: “Corruption Reduction and Raising Anti-Corruption Culture to the Level of Developed European Countries”, establishment and capacity-building of Anti-Corruption Agency will ensure transparency and efficiency • IPA Project Proposal: “Seizure of Proceeds and Property in Court Proceedings”; main objective is to strengthen system effectiveness in seizure of proceeds in court proceedings through operational activities of the Seized Property Management Directorate Ministry of Justice
Basic Challenges of Penal Reform Strategy • Protection of inmates in safe and secure way and in human conditions in conformity with international standards • Promotion of alternative penalty methods • Reduction of the rate of remaining into custody • IPA Project Proposal: “Improvement of penalty system”; the goals are to improve prison conditions by strengthening of existing capacities, improvement of programmes for re-socialization, development of alternative penalty methods and professional training for the staff Ministry of Justice
