ABOUT US • Transparency International Czech Republic (TI CZ) is a non-governmental organization, whose objective is to monitor the state of corruption in the Czech Republic and contribute to its systemic reduction. • What do we work on? • Promoting systemic changes in public administration and legislation. • Long-term projects in the area of public procurement, issues concerning conflicts of interest, lobbying and whistleblowing. • Legal advice.

  4. ANTI-CORRUPTION LEGAL ADVICE CENTRE

  5. Analytical Work of Legal Advice Centre (ALAC) • Findings obtained when providing legal aid to individual clients are generalized. The results of the analytical work are recommendations to improve the tools to curb corruption which are publicly presented by TI– within the legislative process, in the media and during courses. • In 2013, an analysis of 247 judicial decisions concerning bribery from 2010 to 2012 was published.

Public debates • Meetings with the citizensare organized by the ALAC in municipalities which deal with a specific case of corruption. • The debate does not focus on any specific case but on a general topic such as: • Management of municipal property; • The possibility of public scrutiny by citizens; • Internal control mechanisms in the municipal organs; • Right to free access to information. • We also strive to include the representatives of the municipal organs in the debate. In this year, a debate took place in Smržice and themain topic was the newtown plan.

  8. TI PROJECTS 2013MINIMUM STANDARDS OF TRANSPARENCY OF PUBLIC PROCUREMENT, UKRAINE Project objective: to successfully introduce Minimum Standards in selected Ukrainian cities and topromote them in a way that enables their further expansion. Implementation period: 11. 1. 2013 – 31. 12. 2013

  9. ExperienceSharing • In 2013, the Minimum Standards were finalised published in both print and electronic format. They were presented to representatives of local authorities during an international seminar in Lviv in April this year.

  10. Study Visit • Another major project activity was a study visit of representatives of the Berdyansk, Lviv, Nikolaev municipalities along with representatives of Transparency International Ukraine in the Czech Republic. • It included meetings at the Ministry of Regional Development and the Ministry of Foreign Affairs of the Czech Republic, meetings with representatives of the civic association “Oživení” (Recovery)and management of Liberec and Semily municipalities. • The main topic of the study visit was the sharing of experience in access of information on public procurement and specific examples demonstrating the positive impact of greater transparency on the efficient use of public funds.

  12. Lviv sets the example and others join Three more cities have signed the Memorandum of Minimum Standards of Public Procurement in Ukraine in 2013. At the same time other 6 cities expressed their commitment to implement Minimum Standards in their public procurement practice in 2014.

  13. Project Evaluation • The final phase of the project will be devoted to monitoring the implementation of Minimum Standards through questionnaires and personal interviews. Its output will be the Monitoring Report which will serve not only as an indicator of project success but also as a starting platform for other cities, which will gradually introduce Minimum Standards into their work. • The project was funded by the Transformation Cooperation Programme of the Ministry of Foreign Affairs of the Czech Republic and by the U.S. Government Emerging Donors Challenge Fund.

TI PROJECTS 2013EU FundsWatch • Aim:This project intended to research the methods for preventing fraud and corruption used in differentbodies implementing EU funds in participating countries, identify successful ones, exchange anddiscuss best practice at the international conference held in Prague, and disseminate these methods.

  15. “EU Funds: How to prevent the risk of fraud“ Conference • Theconferencetook place in Prague on 16th May 2013. • 82 participants were present -operationalprogrammeimplementersas well asmembersofotherorganizations – EU Fundrecipients, audit and controlorgans and otherinstitutions. • Programmewasdividedintothreepanels: • Internal management organs; • Internationa experience; • External control mechanisms.

Main Risks Associated with theMisuse of EU Funds • Missing or ineffective legislation. • Ineffective selection process of the EU Funds administrators in respective countries. • Lack of transparency in monitoring, control and audits focused on quality. There is a need to strengthen the area of monitoring as well as the capacity of control and audit organs and public oversight.

  17. EU Funds Watch Project The EU Funds Watch projectwassupported by the EU Programme HerculeII (2007-2013). It was implemented by the European Commission in the period from 1st November 2012 to 30th July 2013. Partnercountries were Lithuania, Estonia and Hungary.

What were the KOPS project activities? • Within the project there werepublic debatesorganised in 8 citieswhichwerefollowed by the course. • We always tried to target the public debate on  the most sensitive and topical issue in the city or region. • More information about the project including downloadable materials supplemented with frequently asked questions on the issue of corruption and the answers to them can be found on the project website http://kops.transparency.cz

Courses and Debates • Public debates, in which dozens of people took part, were hosted by Transparency International Czech Republic staff, individual issues were presented by experts in the field, representatives of civil society organisations and initiatives and in in some cities by representatives of municipal authority.  • Courses thematically related to public debates.  • Project timeframe: August 2012 – October2013

  23. Investigative and Analytical TI Section Responsibilities: investigating complaints concerning corruption. How do we obtain information? • Open source analysis; • Own operational work; • Whistleblowers.

  24. About TI Investigative Section Investigation is one of the strategic pillars of the work of TI. The purpose of our work is to protectthepublic interest. Main principles: • impartiality, • professionalism, • avoiding bias, • openness towards public. What do we work on? • Corruption activities of public representatives. • Cases in which serious damage was caused. • Cases with evidence and those with hope for a successful resolution of the case.

About TI Investigative Section • A working group that systematically investigates and analyzes represents a unique project in the Czech NGO environment and within the worldwide TI network. • We communicate with the whistleblowers and use professional analytical software. We discuss our steps with the lawyers and then we consider the next steps. We are glad that we represent a trustworthy partner for the state organs.

  26. Whistleblower Protection We would like to act as an anti-corruption watchdog. TI works on a conceptual project aimed at whistleblower protection and improving the legislative framework on this issue.A special website for whistleblowers www.whistleblower.cz has been launched on 9th December 2013.

  27. TI Cases OFFSHORE destinations • We found out that in the last five years at least 200 billion CZK from the public funds went to the companies in tax havens and anonymous companies. CZECHINVEST • TI got signals about non-standard behaviour of management of this state agency and the information was forwarded to the police. This led to the dismissal of the suspects. DPP (Prague Public Transport Company) • TI analytics were a part of the team that worked on a legal analysis of DPP contracts. Consequently, the police started to investigate these contracts and charges were made.

  28. RECONSTRUCTION OF THE STATE • The aim of this project which involves 18 anti-corruption organizations is to enforce 9 anti-corruption laws. • TI acts as a professional supervisor in three areas: • Law on political parties’ finance • Law on public service • Law on public prosecutor’s office

TRANSPARENT ELECTIONS PROJECT After the success of monitoring of the Czech presidential election finance at the beginning of this year, Transparency International focused on monitoring the parliamentary elections • 12 best practice criteria about transparent finance were evaluated • The final output of both monitoring projects are proposals for legal amendments which will be put forward to the parliament • Otakar Motejl Fund is the partner of this project.
