1. WQD PROPOSED RULE CHANGES SUMMARY OF CHANGES BY RULE DECEMBER 15TH AND 16TH, 2010

2. Chapter 606 - OPDES Standards • Increase annual fees • Establish application fees • Define Categorical Industries • Allow electronic submittal of DMRs if EPA guidelines are met • Application requires additional information from facilities which generate or land apply biosolids in the watershed of an Outstanding Resource Water • Establish control testing and stream monitoring requirements for industrial discharging facilities with permit limits for oxygen demanding substances (similar to municipal wastewater discharging facilities) • Updates incorporation by reference of Federal Regulations to July 1, 2010

3. Chapter 611 – General Water Quality • Establish application fees for certifications required to be issued by the State pursuant to Section 401 of the Clean Water Act • Incorporate Consumer Price Index to adjust these fees as adopted in other chapters • Updates incorporation by reference of Federal Regulations to July 1, 2010

4. Chapter 616 – Industrial Wastewater Systems • Increase annual fees for industrial tank systems, surface impoundments, and land application systems • Make annual fees applicable to all industrial wastewater systems • Establish application fees for industrial tank systems, surface impoundments, and land application systems

5. Chapter 621 – Non-Industrial Discharging and Public Water Supply Lagoons including Land Application • Replace the words “Flow-Through” with “Discharging” and “Impoundments” with “Lagoons” • Implement Senate Bill 1695 which effectively eliminated one of the three current scenarios for ownership (i.e., homeowners’ associations) of an individual or small public sewage treatment system • Remove references to total retention lagoons which are now covered in Chapter 619 • No change to existing fee schedule, however, DEQ will begin collecting these fees

Chapter 623 – Pretreatment for Central Treatment Trusts • Establish a fee for the review and issuance of permits that discharge to a Central Treatment Trust (Oklahoma Ordnance Works Authority) • Incorporate Consumer Price Index to adjust these fees as adopted in other chapters • Updates incorporation by reference of Federal Regulations to July 1, 2010

7. Chapter 626 – Public Water Supply Construction Standards • Increase permitting fees for public water supply construction permits • Provide additional options in obtaining variances • Make variance requirements for this Chapter and Chapter 656 consistent

8. Chapter 631 – Public Water Supply Operation • Modify annual fees for public water supply systems • Updates incorporation by reference of Federal Regulations to July 1, 2010

9. Chapter 656 – Water Pollution Control Facility Construction Standards • Increase permitting fees for municipal wastewater construction permits • Limit who is eligible to obtain a wastewater construction permit in accordance with new legislation • Require information contained in engineering reports to match Funding Agency Coordinating Team (FACT) requirements to aid in obtaining permits and obtaining public funds for construction of projects • Provide additional options in obtaining variances • Make variance requirements for this Chapter and Chapter 626 consistent • Allow any ASTM approved material to be used for manholes

Chapter 656 – Water Pollution Control Facility Construction Standards (continued) • Establish additional criteria for emergency operations at WW treatment facilities, in the event of power outage • Require disinfection from aerated lagoon systems that discharge to designated “Primary Body Contact Recreational” or “Public or Private Water Supply” water body • Require written certification on lagoon seal • Require grit chambers on all mechanical wastewater treatment plants • Establish requirement for vortex-type grit chambers • Require the addition of chemicals if necessary to raise alkalinity to facilitate nitrification for ammonia removal • Limit when a Rotating Biological Contactor may be installed

Chapter 656 – Water Pollution Control Facility Construction Standards (continued) • Require the minimum side water depth of a primary clarifier to be 12 feet • Require specific temperatures to be maintained during sludge decomposition • Allow the use of sludge dewatering boxes • Revoke the rules concerning ozone disinfection • Establish requirements for flocculation and filters • Restrict land applications sites to locations with slopes of 5% or less • Reserve a new Subchapter for wastewater reuse • Create Appendix E which contains an updated County Rainfall Table

12. Chapter 690 – Water Quality Standards Implementation • Establish Appendix B as a list of required minimum quantifiable levels • Establish that facilities with Whole Effluent Toxicity (WET) Limits that have a WET testing failure are now required to pass three consecutive retests within a six-month period or the Department may take further action • Establish that WET retests cannot substitute for regularly scheduled WET testing • Establish that if a permittee has a lethal or sublethal test failure, then WET testing will continue once per quarter for the life of the permit • Establish that WET biomonitoring frequencies cannot be reduced during the first permit cycle

Chapter 690 – Water Quality Standards Implementation (continued) • Allow DEQ to use site specific data to produce a more accurate model • Establish secondary body contact recreational parameters upon primary body contact recreational waterbodies during winter months • Require industries with permit limits for oxygen demanding substances to conduct control tests at the same rate as currently established for municipalities • Require both municipalities and industries to report appropriate control tests in accordance with federal regulations • Updates incorporation by reference of Federal Regulations to July 1, 2010

14. Chapter 710 – WATERWORKS AND WASTEWATER WORKS OPERATOR CERTIFICATION • Define “associated training class” and “DEQ proctored exam” • Clarify information required on application forms and to clarify when exams must be taken • Require four hours of renewal training • Revise the Certification Fee Schedule • Clarify when application fees are forfeited • Clarify when examinations can be taken • Require that other persons who perform daily operational duties hold water works and wastewater works certifications
