1. Context J-M DECHAMPS
Old system • Wagons P • Registering Railway undertakings (RUs) - Registration of wagons • Operations and maintenance conditions: imposed • (Private) keepers J-M DECHAMPS
Today (1) • Legal aspect = Railway Safety Directive (2004/49 including amendments) • RU is responsible for safe operation • RU keeps under control all risks including maintenance. Maintenance may not be imposed to Keepers RU, keepers and maintainers may be different • Registration by public authority J-M DECHAMPS
Today (2) • Old system is not authorised but ... RU may still impose maintenance. RU controls risks by imposing maintenance. J-M DECHAMPS
Today (3) • RU controls maintenance managed by other entities such as keepers. • Economic nonsense: many keepers and RUs exchange wagons. RUs are not capable to control all keepers or all entities in charge of maintenance for keepers! Solution: certification of entity in charge of maintenance (ECM) J-M DECHAMPS
2. Certification of entity in charge of maintenance J-M DECHAMPS
Entity in Charge of Maintenance (ECM) • Certification of ECM • Provide assurance to RUs that the ECM is competent • Unique European certification • The European Commission will adopt by end 2010/beginning 2011 an European regulation based on an ERA recommendation. - The European regulation will be presented to the representatives of Member States in December 2010 (RISC) J-M DECHAMPS
ECM regulation (1) Scope • Mandatory for freight wagon ECMs in EU • Voluntary for certification of maintenance suppliers such as maintenance workshops

ECM Regulation (8) Entry into force • 20 days after publication • 24 months after entry into force: ECM must be certified spring 2013 • Transition: • MoU certificates-> original validity but limited to 4 years after entry into force • Self declaration->until ECM must be certified

3. Questions J-M DECHAMPS
Keeper has no ECM. What happens? Registration must contain identification of ECM incomplete registration the wagon can not be operated! 2) ECM for all wagons? YES, mandatory also for all wagons. Exception: if excluded by the Railway Safety Directive 3) ECM and GCU? No link. ECM is imposed by law, CUU is private contract. J-M DECHAMPS
4) Need of approved workshop (atelier agréé)? Legally the workshop must be approved by the ECM. Workshops approved by a RU and covered by its safety management system may be accepted as competent by the ECM. J-M DECHAMPS
