Synopsis • The New York legislature, at the time of this case, allowed a monopoly of steamboats to be created. • The legislature gave this monopoly to Robert Fulton • His assistant and was Robert Livingston • Livingston allowed Ogden (the prosecutor) to run the steamboat/ferryboat navigation service • Ogden’s steamboat service ran from New York to New Jersey • As a competitor, Gibbons also set up a ferry steam boat service that ran from Elizabethtown, New Jersey to New York City by getting a license from the federal government. • Ogden got an injunctive that didn’t allow Gibbons to run his ferry boat service. • Gibbons sued and appealed his case to the Supreme Court
Court decision • The case was decided in March 2, 1824 • The verdict was in favor of Gibbons • The decision was that federal law trumps state law in the case of interstate commerce • Justice John Marshall decided that navigation counted as commerce. • By looking at the commerce clause of the constitution, Marshall came up with his decision. • So Ogden was finally allowed the right to run his steam boat business
