  1. Child Abuse/Neglect Reporting The New Mexico mandatory reporting law, 32A-4-3 of the Children’s Code, identifies those persons including school teachers, school officials, nurses, and social workers are mandated to report reasonable suspicion of possible child abuse or neglect.

  4. Reporting (con’t) • Reports are made regardless of whether the alleged perpetrator is a parent, stranger, or school personnel. The duty is to report, NOT to investigate.

  5. Reporting (con’t) • New Mexico law further stipulates that a mandated reporter who fails to report is guilty of a misdemeanor and can be sentenced pursuant to the provisions of Section 31-19-1 NMSA 1978. Likewise any person acting in good faith when reporting suspected abuse or neglect of a child is immune from liability, civil, or criminal, 32-4-5.

  6. Responsibilities of school personnel: • Child’s self disclosure: Provide quiet and private place. The person receiving such information should listen openly and avoid judgments. If the child has not spontaneously provided the following information about the abuse, ONLY ASK THESE EXACT QUESTIONS-who, what, when, and where?

  7. Responsibilities (con’t) • Examples: Who did it? What happened? When did it happen? Where were you when it happened?

  8. Responsibilities (con’t) • Document Try to remember the child’s exact words, since these quotes will later be documented.

  9. Responsibilities (con’t) • Do NOT make promises to keep it a secret.

  10. Responsibilities (con’t) • Observation of injury and/or unusual behavior. • Contact the appropriate school personnel who need to know in order to protect the child. It is recommended the principal be advised when child abuse reports are made because investigating agencies often respond first to the main office.

  11. Responsibilities (con’t) • Assist CPS and/or law enforcement upon arriving by sharing information and providing a private interviewing place. • Third party report of abuse/neglect. • If a parent or guardian calls or comes to the school in an effort to locate a child being interviewed, sheltered, or removed from the school grounds, school personnel should refer the parent/guardian to the CPS or law enforcement for information.

  12. Responsibilities (con’t) • School personnel shall maintain confidentiality of all information regarding the report. Do NOT contact or provide information to the parent (s) and/or the alleged perpetrator. Refer all inquiries to CPS or the law enforcement. Premature or inappropriate notifications can hinder investigations.

  13. Responsibilities (con’t) • REMEMBER, IT IS THE RESPONSIBILITY OF THE PERSON RECEIVING THE INITIAL DISCLOSURE OR MAKING THE INITIAL OBSERVAITON OF ABUSE/NEGLECT TO ENSURE A REPORT IS MADE TO THE PROPER AUTHORITIES.
