保單行政事項 Policy Administration 設有『法團校董會』的資助學校會收到以下由昆士蘭聯保發出的文件: The aided school with “Incorporated Management Committee” (“IMC”) will receive the following insurance documents issued by QBE: • 信件 - 上面寫上保單號碼 、保險証書號碼 、 查詢熱線及學校認證密碼 Letter – stipulating the Master Policy No., Certificate of Insurance No., IMCLIP Hotline and School’s Password • 保險証書正本 The Certificate of Insurance (original document) • 保單文件副本 A copy of the insurance policy wording 如學校於法團校董會成立日後的5個工作天內仍未收到上述文件,請致電昆士蘭聯保 – 財務及專業風險 (核保部)(電話 : 2828 9984) In case any school does not receive the above documents within 5 working days after incorporation of IMC, please contact QBE – Financial & Professional Risks – Underwriting Division (Tel : 2828 9984)
保單行政事項 Policy Administration • 如法團校董會學校的名稱或地址在保險期內有任何變更,請盡快透過傳真 3607 0330 或電郵 akklau@qbe.com通知昆士蘭聯保 – 財務及專業風險 (核保部) ,以對保險証書作出相應的更改。 Should there be any change of name or address of IMC school within the policy period, please inform QBE – Financial & Professional Risks – Underwriting Division either by fax 3607 0330 or e-mail akklau@qbe.com as soon as possible. 索償程序 Claims Procedures • 呈報事項 Reporting and Notice • 保單保障期內發生之可能涉及索償之事實及情況【不當行為】 Circumstance, if during the Period of Cover, the Insured becomes aware of any fact or circumstance of a Wrongful Act • 保單保障期內首次提出之索償 Claim, a written or verbal allegation of any Wrongful Act first communicated to the Insured during the Period of Cover • 呈報時限 Time of Reporting • 於保單保障期內及不遲於保單屆滿當日起90天內盡快通知昆士蘭聯保 Notify QBE as soon as practicable during the Period of Cover or no later than 90 days from expiry of the Period of Cover
什麼是索償? What is a Claim? 此包括 : Includes : • 法團校董會成員被書面或口頭形式指控其不當行為;或 IMC Manager received a written or verbal allegation of any Wrongful Act ; or • 收到民事訴訟程序當中的投訴書、傳票、索償陳述書或有關狀書指控其不當行為;或 Received notice of a civil proceeding commenced by the service of a complaint, summons, statement of claim or similar pleading against any Insured alleging any Wrongful Act; or • 收到刑事訴訟程序中的傳票或控罪指控其不當行為。 Received notice of a criminal proceeding commenced by a summons or charge against any Insured alleging any Wrongful Act.
不當行為及索償通知期之計算Wrongful Act and Critical Date for Claims Notification 保單保障期 Period of Cover 追溯日期 Retroactive Date (即為法團校董會成立之日 Date of establishment of IMC) 例如 e.g. 02-07-2012 保單生效日 Inception Date 01-09-2012 保單終止日 Expiry Date 31-08-2015 不受保事例 Exclusion 在保單生效日前首次知悉或收到之索償 The Insured became first aware of the circumstance or Claim prior to Inception Date (即:2012年8月31日或以前) (i.e.:on or before 31 August 2012) 不受保事例 Exclusion 不當行為發生於追溯日前 Wrongful Act happened prior to Retroactive Date (依上述例子即:2012年7月1日或以前) (i.e.:on or before 1 July 2012) (1) (2) 受保事例 Covered Wrongful Act (i) 不當行為發生於追溯日或以後; Wrongful Act happened on or after the Retroactive Date; 及AND (ii) 於保單保障期內首次知悉或收到之索償; During the Period of Cover, the Insured became first aware of the circumstance or Claim; 並在AND (iii) 保單終止日或以前通知保險公司 On or before the Expiry Date, the Insured had reported the Claim or circumstance to QBE (3) 不受保事例 Exclusion (i) 不當行為發生於保單終止日後; Wrongful Act happened after the Expiry Date; 或OR (ii) 於保單終止日後首次知悉或收到之索償; After the Expiry Date, the Insured became first aware of the circumstance or Claim; 或OR (iii) 於保單保障期內首次知悉或收到之索償但沒有在保單終止日或以前通知保險公司 The Insured first became aware of the circumstance or Claim during the Period of Cover but had not reported to QBE on orbefore the Expiry Date (4) • 獲賠償的先決條件:發生於保障期內之不當行為及已預期可提出或已提出之索償,必須盡快於保障期內及不遲於保障期屆滿當日起90天內呈報保險公司。 • Claims Condition:During Period of Cover, if the Insured became aware of any circumstance or Claim, the Insured must report to QBE during Period of Cover or no later than 90 days after the Expiry Date.

查詢熱線 IMCLIP Hotline • 處理索償的支援 Support for Claim Handling • 不會提供法律意見 Will not provide any legal advice • 查詢會被錄音 Inquiry will be audio recorded • 查詢熱線電話由香港其禮律師行接聽 The Hotline is operated by Clyde & Co • 接聽熱線時間為星期一至星期五上午九時至下午五時正(不包括星期六、日或公眾假期) The Hotline operating hours : 9:00a.m. to 5:00pm from Monday to Friday (except Saturday, Sunday and Public Holidays)
索償通知 Claim Notification 任何索償的通知均須以書面形式遞交致昆士蘭聯保保險有限公司,通訊地址如下: Notice of any Claim shall be given in writing to the Insurer, and delivered to:
索償注意事項 Claims Conditions • 對於任何索償包括口頭索償、索償函件、傳票或訴訟文件等,不應私下進行抗辯或和解 The Insured agrees not to settle any Claim, make any admission, offer or payment with respect to any Claim (whether verbal or written) • 請勿自行回覆任何信件、訴狀或傳票,並必須立刻將其副本交予昆士蘭聯保處理Please do not reply to any letter, complaint, summons, statement of claim or similar pleading, and must submit copies of the same to QBE for handling • 如未取得保險公司書面同意,法團校董會或其校董決不可就任何索償進行商議、繳付、協議、承認或拒絕賠償的行動 The IMC or its Managers agree not to settle any Claim, make any admission, offer or payment with respect to any Claim without the QBE’s written consent • 昆士蘭聯保有權於任何時間以法團校董會的名義進行抗辯或償付任何索償 QBE may at any time on behalf of the IMC school defend or settle any Claim
索償注意事項 Claims Conditions • 受保人提供協助及減低損失 Claims Mitigation and Co-operation • 披露所有相關資料為調查、抗辯索償及向昆士蘭聯保提供協助Disclose to QBE all relevant information and provide assistance to the QBE • 作出一切合理行動以避免或減低損失Do all things reasonably practicable to avoid or diminish any loss
