ORIGINAL APPROVAL • PLDRB unanimously approved S.E. in 2009 • Approval allows 94,963 sq. ft. warehouse expansion to existing 144,718 sq. ft. office/warehouse facility to create 239,681 square foot facility located on 17.4 acre site
Unified Land Development Code • Unified Land Development Code (ULDC) Chapter 2, Part II. Development Orders and Agreements – Applications and Procedures, Section 2.07.04 D. Expiration or Abandonment of Special Exception Uses states: If a special exception does not begin to serve the purpose for which it was granted within twelve (12) months from the date of rendition it shall expire. Provided, however, that the Planning and Land Development Regulation Board may establish a shorter or longer period of time for a special exception to commence. In addition, the Land Use Administrator may extend the special exception for up to an additional twelve (12) month period of time if the applicant can demonstrate good faith reliance. Good faith reliance may include, but is not limited to, the securing of any required permits from other governmental agencies/jurisdictions or the expenditure of substantial funds in reliance on the approved special exception.

Yes. • Each standard is listed and evaluated; Performance Standards? – Yes. None listed in ULDC for use; in compliance with conditions of approval, including approval of site plan;
ANALYSIS OF REQUESTED TIME EXTENSION Supplemental information: • Binding lot agreement executed; • City vacated easement and accepted new easement to accommodate project; • SJRWMD E.R.P. issued – mitigation of wetlands – required Governing Board approval and mitigation payment; • US ACOE permit issued.
