Negotiations Process • 2004-2005: Waitangi Tribunal Hearings • June 2010: Waitangi Tribunal Report released • October 2012: Crown recognised Deed of Mandate • July 2013: Signed Terms of Negotiation with the Crown • Current: Negotiating towards Agreement in Principle • December 2015 (approx): Cabinet consider AIP Package • March 2016 (approx): Sign Agreement in Principle • March 2017 (approx): Sign Deed of Settlement • June 2017 (approx): Settlement legislation
Status of Negotiations • Still working towards the Agreement in Principle package being approved by Cabinet in December • Good progress in many areas but a number of key components of the package are still outstanding / to be agreed • Negotiators are also working though the overlapping claims process with Rangitane Settlement Negotiations Trust
Negotiation Goals • Goal One - Kahungunu Iwi: Uphold the Mana of our Iwi from Tamaki to Wairarapa • Goal Two - Kahungunu Marae and Hapu: Uphold the Mana of Our Marae and Hapu • Goal Three - Kahungunu Whanau: Create a platform to enable our people to thrive culturally, socially and economically

Commercial Redress • Cash quantum – first offer of $75 million refused and awaiting next offer • 70% of Ngaumu Forest (plus ARs) agreed • Negotiating for return of Landcorp Farms • Deferred Selection of OTS Landbank, Ministry of Education and LINZ Properties under negotiation • Right of First Refusal over Crown owned properties under negotiation
Cultural Redress - Properties • Cultural redress properties under discussion (subject to resolution of overlapping claims and Cabinet approval): • Vesting of DoC land • 90% of Wairarapa Moana (if vested) • Overlay classifications • Deeds of Recognition • Statutory Acknowledgements
Cultural Redress – Natural Resources • Redress over Tamaki-Nui-a-Rua rivers under negotiation • Permanence for Te Upoko o Te Taiao (GWRC Natural Resource Committee) under negotiation • Wairarapa Moana Board and funding for restoration under negotiation • Relationship agreements with DoC, MfE and LINZ agreed
Cultural Redress: Other • Specific customary fishing regulations for Wairarapa Moana & Ruamahanga catchment offered (but will be subject to consultation with hapu) • Appointment as Fisheries Advisory Committee offered (areas to be agreed) • Place name changes (list to be finalised)
Relationship Redress • A number of agreements have been reached: • He Kawenata Hou • Letters of commitment with DIA (Archives NZ & National Library) & Te Papa Tongarewa • Taonga Tūturu Protocol • Letters of commitment with Historic Places Trust • Letters of introduction • Crown Minerals Protocol
Relationship Redress Cont’d • Others are still under negotiation: • Relationship agreement between MPI, NKII and all Ngati Kahungunu large natural groups in relation to fisheries management
Historical Redress • Historical Account - Agreed summary of the NKKWTNAR /Crown relationship since 1840 • Crown Acknowledgements - The Crown’s acknowledgement of its Treaty breaches • Crown Apology - The Crown’s apology to NKKWTNAR for its breaches of our Tiriti o Waitangi relationship • The Agreement in Principle will only include the Provisional Crown Acknowledgements – these are currently under negotiation
Next Steps • Working towards Cabinet considering the AIP package in December • Will then present the proposed package at the AGM and hold Hui-a-Iwi to ratify the Agreement in Principle • Timeframe depends on the timing of the next Crown offer and whether it is good enough
