Genesis of BIS • Government of India resolution on 3 September 1946 for establishment of Indian Standards Institution • Indian Standards Institution (predecessor of Bureau of Indian Standards)set up on 6 January 1947 • Objectives • Promoting standardization ,quality control and simplification in industry & commerce • Bureau of Indian Standards (BIS) • Established on 1 April 1987 under BIS act, 1986 as statutory body

Genesis of BIS Bureau of Indian Standards • Bureau of Indian Standards (BIS) took over work of ISI through enactment of BIS Act (1986) by the Indian Parliament. • Formulates National standards and carried out conformity assessment by operating the Product and Management System Certification Scheme. • Formulated over 18000 National Standards and also operating more than 22000 Certification licenses. • Project India’s view in various committees of International Organization for Standardization (ISO) and International Electrotechnical Commission (IEC)

Objectives • Harmonious development of activities of standardization, marking and quality certification • To provide new thrust to standardization and quality control • To evolve a national strategy for according recognition to standards and integrating them with growth and development of industrial production and exports

International Activities India (BIS) is a member of International Organization for Standardization (ISO) and International Electro technical Commission (IEC) Membership of ISO/IEC Committees ISO IEC Participating (P) 187 63 Observer (O) 110 84 Secretariat responsibilities held for 8 ISO Committees BIS has been designated as the WTO-TBT Enquiry Point in India It provides all necessary assistance and technical information for players in global trade which effects their trade

MOU / MRA with Other Countries • BIS has entered into MOU with 15 Standard Organizations of various Countries. • These MOUs generally cover exchange of information, publications, standards and conformity assessment, holding joint seminars/workshops on subjects of mutual interest and training. • MRA 2 • BIS is also actively involved in the Regional • cooperation under SAARC.

  28. Comment Period • At least 60 days time for other Members to make comments in writing • Discuss these comments upon request • Take into account these written comments and the results of these discussions • Reasonable time for enforcement of measures after publication

Role of BIS under TBT Agreement • Functions as an Information Centre within India • Functions as an WTO TBT Enquiry Point Functions of Enquiry Point: • Collect TBT Notifications from WTO website • Classification of TBTs based on ICS codes • Sort out these Notifications sector wise/ Product wise • Electronic Disseminate the TBT on Technical Regulations, Standards and Conformity Assessment Procedures to various groups/ industry/ exporters • Provide the text of the Notifications issued by the countries to other member countries • Comments handling of the stakeholders. • To forward those comments to WTO Sectt through the Nodal Authority which is MOC in India’s case

INDIA’s RECENT COMMENT ON TBTs NOTIFIED BY USA • G/TBT/N/USA/234 : Comments of Textiles Committee, Ministry of Textiles,: “ It has been commented that it is desirable that such requirement (Flammability) should not be made mandatory as the woolen carpets have inherent flame retardancy. The Proposed Amendment by Consumer Products Safety Commission, CPSC, USA would be trade restrictive , if the consignment is to be tested for flammability as a mandatory requirement “

INDIA’s RECENT COMMENT ON TBTs NOTIFIED BY USA • G/TBT/N/USA/271: Objective For the protection of consumers and human health. • Products : National Organic Program • This proposed rule proposes to amend the Department of Agriculture's (USDA) National List of Allowed and Prohibited Substances (National List) regulations. This proposed rule proposes to add 38 substances, along with any restrictive annotations, to the National List regulations. • Notification No G/TBT/N/USA/271 of USA was notified by WTO on 24 May 2007 whereas the last date for sending comment was 22 May 2007. Issue referred to US Enquiry Point on 5 June 2007 : Also requested to extend the last date of comment • Response from US EP : USDA is unable to extend the deadline

INDIA’s RECENT COMMENT ON TBTs NOTIFIED BY USA • G/TBT/N/USA/271 : USA:: Comments of Agricultural and Processed Food Products Export Development Authority (APEDA) “ The notification proposes to amend the United States Department of Agriculture’s (USDA) National List of Allowed and Prohibited substances for inclusion of 38 substances along with any restrictive annotations to the national list regulations 205.606. APEDA have examined the thirty-eight substances which are of agricultural origin, but are not organically produced for use as ingredients / processing aids in or on processed products labeled as organic. The list of the proposed products for inclusion are annexed along with the proposed rules of NOP. These products are also available organically worldwide and are, therefore, available for use as processing aids and for food colour. Hence, they should not be exempted from the class of organic origin. This will be against the organic principles and may affect the overall integrity of the final produce”.
