Appropriate legal and institutional frameworks are required to ensure climate resiliency for natural resources investments Effective management of climate risks and applied adaptation measures directly depend on the legal framework and existing institutional capacities of the country.   3. The National hydrometeorological services of Tajikistan (NHMS) is a specially authorized state body, responsible for systematic observations of the climate system and the environment. The observation data is used for decision making on mitigation of the damage from the extreme weather events. ADB TA7599 TAJ Climate Resilience for Natural Resources Investments

  4. ADB TA7599 TAJ Climate Resilience for Natural Resources Investments • Climate protection is regulated by Article 52 of the TJ Law on «Environment protection». In accordance to this article it is necessary to organize systematic observations of climate change, development of long-term programs associated with reduction of human impact on climate.

  7. The National hydro-meteorological services doesn’t have appropriate financial and technical resources. This situation negatively affects the quality of climate information, hydro-meteorological forecasts, including flood and other natural hazards, limiting the development of climate studies. ADB TA7599 TAJ Climate Resilience for Natural Resources Investments • In accordance to the Resolution №323 of the Government of TJ from August 3, 2002 (changes №416 from august 3, 2007) «On the issues of SCGoT on Emergencies» all activities on preparedness to natural disasters and liquidation of its consequences conducted under the authority of the Government of Republic of Tajikistan (GoT), through the State Commission for Emergency Situations (ES).

ADB TA7599 TAJ Climate Resilience for Natural Resources Investments • The Committee for Emergency Situations and Civil Defense of the GoT (CoES) provide guidance to the state policy in the field of preparedness and protection of the population, economic facilities of the country from the consequences of emergency situations. • The CoES manages directly the activities on prevention and liquidation of consequences of natural disasters.

Institutional frameworkMajor work on monitoring of natural hazards carried out by: ADB TA7599 TAJ Climate Resilience for Natural Resources Investments • Head Department of Geology under the GoT (landslides,karst phenomena,rockfalls) • State Agency for Hydrometeorology (heavy precipitation, hail, strong winds, drought, dust storm, frost, avalanches, debris flows, floods). • Institute of Geology and Seismology under the Academy of Sciences of TJ studying the conditions and causes of some natural disasters (landslaides, earthquakes).

  12. ADB TA7599 TAJ Climate Resilience for Natural Resources Investments INVESTMENT CONDITIONS • Currently Tajikistan set up certain conditions to attract foreign investments. In 1992 the TJ Law on «Foreign investments» was adopted. • The Government developed and implementing the State program on investments (1992). • For the period of 2003-2015 it is foreseen to increase investments and foreign loans, out of which 30% will be direct investments and 70% - international loans. • The internal investments in environment protection for the last years are low and constitute 0,07% of GDP.
