THE BASIC LAW OF GUIDELINES FOR OCCUPATIONAL, SAFETY, AND HEALTH IN THE CONSTRUCTION INDUSTRY OF INDONESIA : JOINT DECISION OF MINISTER OF MANPOWER AND MINISTER OFPUBLIC WORKS NUMBER : KEP.174/MEN/86 NUMBER : 104/KPTS/1986 IN REGARD TO OCCUPATIONAL SAFETY AND HEALTH IN CONSTRUCTION ACTIVITY SITE MINISTER OF MANPOWER AND MINISTER OF PUBLIC WORKS

  6. CONSIDERS: a. Whereas a construction work is a work complexity which involvesconstructionmaterials, equipment, technology application and manpower, may be the source for occurrence of work accident. b. Whereas the workers in constructionproject, as the resources required in thecontinuity of the construction, needs tobe given proper work protection, particularlyagainst the risk of workaccident. c. Whereas in that consideration, animplementation of work safety and health norms, on the construction site, needs to be properly exerted. d. Whereas in that consideration, it is necessary to establish a Joint Decision of the Minister of Manpower and the Minister of Public Works.

  7. Bears in Mind: 1. Act Number 1 of 1970 in regard to Work Safety. 2. Government Regulation Number 9 of 1941 in regard to General Terms For the Implementation of Tendered Public Buildings. 3. Presidential Decree Number 45/M of 1983 in regard to the Establishment ofDevelopment IV Administration. 4. Presidential Decree Number 44 of 1974 in connection with Presidential Decree Number 15 of 1964 in regard to Organization Structure of GovernmentalDepartments. 5. Regulation of Minister of Manpower Number: PER.01/Men/1980 in regard to Work Safety and Health in Building Construction.

RESOLVE: Establish: Joint Resolution of Minister of Manpower and Minister of Public Work in regard to Occupational Safety and Health Article 1 As the technical requirements in the implementation of the Regulation of Minister of Manpower and Transmigration Number PER.01/Men/1980 in regard to Occupational Safety and Health in Building Construction, it is hereby established as general guidance theapplication of Implementation Manual Book on Occupational Safety and Health in Construction Site, hereinafter referred to as Manual Book and shall form a part of this Joint Decision. Article 2 Every Managers, Contractors, Chief of WorkImplementation or Work Division in any performance of construction activity, shallbe required to comply with the terms of Occupational Safety and Health as set out in the Manual Book as provided in Article 1. Article 3 Minister of Public Work shall have the authority to apply any administrative penalty to any persons mentioned in article 2 in theevent of any non-compliance to therequirements as specified in the Manual Book.

Article 4 Any matters which concerns to the managementin the application of this Joint Decision shall be done in coordination among Headquarter, Local offices of Department ofManpower and Department of Public Work. Article 5 In regard to the implementation of Article 4 of this Joint Decision, Minister of Manpowermay appoint Experts in Construction Occupational Safety and Health within the environment of Department of Public Work upon request of the Minister of Public Work, in pursuant to theterms of article 1 clause (6) of Act Number 1 of 1970 in regard to Work Safety. Article 6 Supervision on the implementation of thisJoint Decision, shall be made functionally bythe Department of Manpower and Department ofPublic Works in accordance with theirrespective scope of duties andresponsibilities. Article 7 Any matters which has not been governed inthis Joint Decision shall be stipulated further by the Minister in concern inaccordance with their respective authority.

CONCLUSION : Construction is a relatively very complex work, needs knowledge, mastery, planning, preparation and particularly there must be a better integrated work coordination during a period of construction activity. Carefulness in the construction project is insufficient if only reflect to the people Who are at location of the project, but have to include and involve, the society of the construction service to arrange how to do / conduct a correct action so that can obviate accident or at least lessening risk of accident A lot of party who active in the construction service activity have not yet thought seriously about a possible risk, but only see a big advantage. The meaning of the construction service society is the people who interest or have activity that related to the business or the work of construction such as : Service Users, Services producer and Workers of the construction activity.

The rule of occupational safety and health in construction basically have the same meaning with the common occupationalsafety and health intended, for example, to give safety for the construction workers in order to avoid from possibility of risk of accident work in each step to do their duty maximally. The paradigm changes or reformation construction that happened in Indonesia about UUJK (Construction Services Constitution) indirectly also will correct service of this construction including K3 (health and working safety), namely existence of awareness and attention to human rights which must get placed by first priority by employer or one who employ worker, and also the institution doing/conducting and observation to be called to account by /if when occur of accident work at Construction Work Management
