Location of publication • General rule: publication on a common TSO website envisaged • Obligation to publish is on TSOs • ETSOVista as option • Information could be published at websites of PEX, but • no voluntary publication scheme, i.e. information about all power plants > 100 MW is published • open to all market participants, not only participants of PEX
Data Provision • TSO is responsible for publication • Market participants obliged to provide TSOs with relevant data • Provision of data of market participants not connected to TSOs grid • Data available to DSOs • Obligation of DSOs to provide TSOs with this data • Enforceable by NRAs or other competent authority

Legal issues • Transparency Report is not a legal act by itself • BUT: • Demonstrates common interpretation of CEE NRAs concerning transparency rules of binding Congestion Management Guidelines (cf. chapter 5) • Compliance with these guidelines will be monitored on basis of this common interpretation
Public consultation • Public consultation of CEE Transparency Report • Started beginning of October • Ended October 31st, 2007 • Comments received: 13 • 4 TSOs • 3 generators • 1 cartel office
Topics addressed 1/2 • Data confidentiality • Aggregation per bidding area/ control area does not prevent disclosing of business secrets in some small CEE markets • No publication of disaggregated values concerning consumption units • Surveillance/ sanctions • Both are seen necessary to further functioning of markets
Topics addressed 2/2 • Detailed proposals • on generation (e.g. no publication of ex post values unit by unit) • on balancing (e.g. concerning responsibility for publication: TSO or Market Operator?) • Transparency should be harmonized within Europe • No excessive demands from TSOs and DSOs • Transparency is not to be confused with market surveillance
Further steps in the CEE - Region • Evaluation of the comments by stakeholders provided in November 2007 • Discussion of open issues in IG Transparency (December 4th, 2007) • Finalisation and publication of the Report early 2008
