  15. What’s inside? • When an employer can conduct a background check • What they can ask • What steps employers must take before they use a background check • What to do if an employer finds something negative

  16. Can employers require a background check? YES, but … • Can’t ask about medical info until after job offer • Can’t ask for genetic info, except in limited circumstances • Can’t treat you differently because of race, national origin, color, sex, religion, disability, genetic information or age (if you’re >40).

  17. Before the background check • An employer must provide stand-alone written notice to the applicant; and • Obtain the applicant’s written consent • Note: The applicant is not required to consent but if he doesn’t, then he may not get the job.

  18. Before denying employment based on background check • Pre-adverse action notice • Employer who thinks it might take an adverse action based on background check, employer must: • Give copy of report • Give copy of FCRA Summary of Rights

  19. When denying employment • Adverse action notice • Employer must • give contact info for CRA that provided report & statement that CRA didn’t take the action • Give notice of right to dispute accuracy & completeness • Give notice of right to obtain another free copy of report within 60 days
