Outlet Conditions • Natural berm build-up periodically occurs at the outlet, minimizing water flow to the ocean and causing water to pool at the outlet. • High tide and surf at Poche contribute to the water in the pond. • Outlet waters rise and flood the catwalk due to reduced flow. Past Permits and Constraints • Past Permits Conditions • Limited to semi-annual maintenance (Spring and Fall) • Required obtaining separate authorizations for non semi-annual maintenance • Constraints • Western snowy plover and grunion monitoring requirements • Water quality monitoring requirements POCHE BEACH OCEAN OUTLET MAINTENANCE PERMIT STATUS

Current Permitting Efforts • Agencies involved in obtaining long term maintenance permits: • United States Army Corps of Engineers: Application submitted November 2010. • During application processing, the Corps consults with United States Fish and Wildlife Service and the National Oceanic and Atmospheric Administration • Regional Water Quality Control Board, San Diego Region: Application submitted November 2010.   7. Current Permitting Efforts • California Coastal Commission: Application submitted December 2010. Commission approved application with special conditions in June 2011. • California Department of Fish and Game: Concluded maintenance activity not subject to Fish and Game Code (FGC) Section 1600 et al in April 2010. Current Permitting Efforts • Details of Permit Requests • Allowance to conduct minor, routine maintenance • Proposed routine maintenance triggers: • Sand berm present • High tide present or increasing • Water level 6 to 12 inches below catwalk • Uncertain if agencies will allow maintenance under proposed triggers.
