    3. Drinking Water Fee Increase

    4. 401 Water Quality Certification Waiver On Oct. 22, 2010, DHEC published a notice in the State Register announcing (due to continuing budget cuts) it was necessary to reduce its resources in the 401 program. The Department identified categories of projects for which the 401 Certification would be waived as follows: Nationwide Permits issued by the US Army Corps of Engineers Groin and Beach Renourishment Projects. Appealed by several conservation groups to the ALC.

    5. Triennial Review: Water Quality Standards The public hearing before the Board was rescheduled for February 10, 2011 (based on Board meeting schedule change).   Among the issues being proposed is the elimination of one of the bacterial standards in SA and SB waters. There are currently two bacterial standards in SA and SB waters to protect for recreation: fecal coliform and enterococcus. DHEC is proposing to eliminate the fecal coliform standard and retain the enterococcus standard. Also, DHEC initially proposed replacing the fecal coliform bacterial indicator for freshwaters with E. coli, but need more stakeholder input to reach consensus (ongoing work)

    6. DHEC is also proposing to revise the allowable deficit for DO in naturally low DO waters (to match new state law). Proposing to reinstate the arsenic MCL for human health protection for consumption of water and organism and organism only Adopt revised acrolein and phenol criteria.     7. Savannah Harbor Expansion Project On November 15, 2010, the US Army Corps issued a Joint Public Notice for the improvements and continued maintenance of the Savannah Harbor Federal Navigational Project. The notice served several functions. It announced the availability of the Draft Environmental Impact Statement and provided a 60 day public comment period. It also served as an application to both DHEC and the Georgia DNR for 401 Water Quality Certification purposes and Coastal Zone Management consistency determinations.

    8. Savannah Harbor Expansion Project DHEC wrote the Corps explaining the 60 day time was not enough – expecting to use the one-year schedule allowable by rule. On December 30, 2010, since the Corps had not agreed -- DHEC sent issued a proposed decision denying certification for the project without prejudice due to the lack of adequate review time. On January 13, 2011, the Corp sent correspondence acknowledging the one-year review time On January 14, 2011, DHEC rescinded its denial decision.
