THE CAMEROON ROAD FUND • A Public Administrative Establishment • Under the authority of the Ministry of the Economy and Finance • Institutional Framework of the FUND : • Law n° 96/07 of 08 April 1996, on the Protection of the Road Network of Cameroon ; • Law n° 98/011 of 11 July 1998, modifying and completing certain dispositions of law n° 96/07 of 08 April 1996 ; • Law n° 99/016 of 22 December 1999, on the general statutes of public establishments and public et Para public sector corporations; • Law n° 2004/021 of 22 July 2004, modifying and completing certain dispositions of law n° 96/07 of 08 April 1996 ; • Decree n° 98/162 of 26 August 1998, fixing the modalities of the functioning of the Road Fund; • Decree n° 2005/239 of 24 June 2005, organising and fixing the modalities of functioning of the Road Fund. This last decree broadened the duties of the Fund by adding an «office for Investments» above the « Maintenance office» and increasing the number of workers from 15 to 20 persons. THE VOTE HOLDERS OF THE ROAD FUND • The Ministry of Public Works which is responsible for: • Routine and Periodic maintenance as well as the rehabilitation and construction of the priority inter-urban network of earth and sealed roads, • The maintenance, rehabilitation and construction of rural roads of the priority network, • The protection of the national road network (management and maintenance of weigh bridges and rain gates), • The supervision and control of road works. • The Ministry of Urban Development and Housing responsible for: • The maintenance, rehabilitation and construction of priority urban roads (earth and sealed roads and drainage); • The supervision and control of road works. 1998 – 1999 CAMPAIGN • The consultation for the selection of the auditor was restrained to twelve Consultants. • For this campaign only the MINPW was involved • The audit mission was divided into three lots and two companies were retained : • Lot 1 –North network by Cabinet E. REMARKS AND RECOMMENDATIONS OF THE AUDITOR • For this campaign, only the MINPW carried out works and the technical audit was à posteriori. • Les principal remarks and recommendations were on : • the good quality of control, but the control engineers had too much ground to cover and found it hard to be efficient; • the poor quality and equipment of enterprises, few real enterprises ; • the insufficient definition of works realised, • generally only executed work was paid for, a positive point ; • two flagrant work cases on rehabilitation were observed. REMARKS AND RECOMMENDATIONS OF THE AUDITOR • Analysis of the contract award conditions : no real transparency existed. This could hamper the emergence of competent SME. • On the ground, the road axis were uncertain. Perhaps GPS coordinates study should have been done. • The system of closing the contracts on a fixed date could have favoured the mediocrity. This practice should be abandoned. • Put in place at the level of the RF an evaluation of realisations of the campaign so that the approval of programming takes the state of the roads into account and that the weak enterprises should be known during the campaign. • Avoid engagements of funds which could lead the RF to have difficulties with its treasury. REMARKS AND RECOMMENDATIONS OF THE AUDITOR • The unit prices of medium term contracts are higher than those of annual contracts. • The observed weaknesses of programming persist. • At the level of MINVIL and MINUH, the programming weakness is in engineering leading to a poor quality of works executed. For these two Vote holders some of the works were eligible for RF financing. • The follow-up of contracts was improved at the level of the RF thanks to a programme put in place graciously by the auditor. There is a serious problem of storage space. • The technical assistance of PERFED II (EU funded) has put in place a homogenous system of billing which considerably improves the follow-up and coordination for the supervising consultants. AWARD OF TECHNICAL AUDIT CONTRACTS FOR TWO CAMPAIGNS • The Management Committee of the RF was concerned about efficiency of the expenditure. • The auditor comes in at the end of the campaign and it is difficult to appreciate the quality of works on the roads especially earth roads. • The recommendations did not seem to be followed by the vote holders. • The audit contract should be done over two campaigns to gain time on the consultation and mobilisation. • The idea of a seminar of restitution of observations and recommendations of audit reports was introduced. REMARKS & RECOMMENDATIONS OF THE AUDITORS • Necessity of anticipation in the preparation of tasks making up the cycle of projects. • Necessity of having a data bank (unit prices, road data, performances of actors, ...). • Necessary to establish standard documents (call for tender, quantity estimates, as built plans, ...). • Inadequacy of studies in the urban projects. • Apply the contract Code and introduce criteria and sub criteria for evaluation in the call for tender. • Improve the management of documentation . REMARKS & RECOMMENDATIONS OF THE AUDITORS • Verify the conformity of personnel in the submission and at the job site. • Organise periodic coordination meetings. • Find a means to verify the authenticity of documents attached to bills (cautions, insurance, ...) • Find a way to award the contract for the management of rain gates to another company other than the one executing works who is no longer on site. • Give the control of materials its place to permit it to guarantee the control of the quality of works. • Improve the follow-up of contracts at the level of vote holders so that the general and final bill should be established and the dossier filled at the RF. THE FOLLOW-UP OF THE EXECUTION OF THE MATRIX OF ACTIONS AFTER THE SEMINAR • A matrix of actions is elaborated on the last day of the seminar of restitution of recommendations of the report of the technical audit. • The matrix of actions is widely distributed but the actions are not executed after. • This is why a follow-up committee for the execution of the actions of the matrix and preparation of the next seminar was set up. THE MAIN IMPROVEMENTS • PROGRAMMING : • The vote holders are organising specific structures in charge of programming. • Medium term contracts will be prolonged. • Steps are being taken to systematically plant mile stones on the road network. • The as-built plans and the collection of data on degradations will be sent to the programming service. • The RF management committee will keep an eye on the advancement of the ongoing achievements in year (n) before the approval of programming in year (n+1) from the vote holders. • Studies have been launched for the definition and classification of the urban network in the cities of Yaounde and Douala by the MINDUH. THE MAIN IMPROVEMENTS • AWARD OF CONTRACTS • The ARMP will produce standard tender documents. • The tender boards must be kept informed of the performances of contractors tendering. • The vote holders have planned to have structures in their organisational charts for the creation of data banks . • The criteria and sub criteria for the evaluation of submissions are already in the calls to tender. THE MAIN IMPROVEMENTS • EXECUTION OF WORKS • Thanks to MAIER, the MINPW takes note of all the faults and applies planned contractual penalties. • The RF Management Committee has put in place a follow-up Committee for the application of the actions planned in the matrix of actions elaborated during the seminar. • Meetings exists in the MINPW, the MINDUH has not yet reacted. • The Road Fund and the Banks have established a means of communication which will guarantee the verification of cautions. • The MINPW has created a Division for the Protection of the Network and the Environment of Roads. • Working sessions are planned between the RF and the vote holders to verify the general and final bills.
