Eligibility Requirements for Veterans Veterans who: • Meet at least one of the following ‘time of entry’ requirements: • Entered service in Texas, • Declared Texas as Home of Record, or • Was a Texas resident • Served at least 181 days on activemilitary duty excluding training • Honorably Discharged or a General Discharge under Honorable Conditions • Reside in Texas (new recipients beg. fall 2011) • Not in default on state student loan The HE-V application should be completed by the veteran applying to use the Hazlewood Exemption. Eligibility Requirements for Dependents of Disabled, Deceased, or MIA Veterans Must be child or spouse of a veteran who: • Was killed in action, • Became totally disabled for purposes of employability, or • Went missing in action Dependent children, spouse: • Veteran must meet at least one ‘time of entry’ requirement • Child/spouse must be TX resident • Child must be 25 years or younger (Effective fall 2011) • Each recipient may use up to 150 hours of the Hazlewood benefit Only the HE-D application needs to be completed by the children or spouse applying for their own benefit through the Hazlewood Exemption. Legacy Act • Veterans may: • Re-assign hours to only one child at a time • Revoke hours from child • Transfer from one child to another child Assigning unused hours to an eligible child: • Biological, adopted, stepchild or claimed as veteran’s dependent • Child must be 25 years or younger on 1st day of semester • Child must be Texas resident • Must meet SAP When applying for the Legacy Act the applicant will need to submit both applications. • HE-V application • HE-D application Hazlewood Exemption Database Report
Loan Default Verification • The institution must confirm that the veteran, spouse, or child is not in default on an education loan made or guaranteed by the State of Texas. • Students w/loans thru HHCSLP – • Studentsshouldlogon to www.HHLoans.com to register, print confirmation of loan status, submit to the institution. • Students w/out loans thru HHCSLP – • Institutionsshould submit secure e-mail with attachment listing students to be verified. To request access, send a message to Hazlewood@thecb.state.tx.us to request setup. New Hazlewood Database Report • Enables accurate tracking and monitoring of Hazlewood hours used by veterans, spouses, and children, including Legacy students • Allows schools to report Hazlewood students directly to the database in “real time” • Enables schools to report retroactive awards and revisions • This report does not replace the information reported for Hazlewood students through the CBM001. Data elements 2 – 7 pertain to information about the recipient. Relevant for the hours reported Data elements 10 - 13 will identify the number of hours used and the value of the Hazlewood exemption. Data elements 18 – 23 pertain to information about the service member.
Data Elements 10 and 11 • Data Elements 10 -11: • Pertain to the number of hours that were covered by the Hazlewood Exemption when stacked with federal VA benefits that pay directly towards the cost of tuition and fees. • Ch. 33 Post 9/11 GI Bill • Ch. 31 Vocational Rehabilitation • Awards are Prorated when Hazlewood and Federal Hours Used • Hazlewood should be credited only with the share of the term’s charges that are paid for by the exemption when stacked with federal VA benefits. • Example: • Student takes 12 hours • Total tuition and fees = $1000 • Amount Exempted = $400 (HW hours used) • Hazlewood Hours = 400/1000*12 = 4.8 hours rounded to 5 hours. • Data Element # 10: Hazlewood Hours = 05 • Data Element # 11: Federal Hours = 07 Hazlewood Exemption Database Report
Data Element 15 • Recipient’s Dependency Status : • Hazlewood recipients do not have to be a dependent of the qualifying veteran in order to receive the Hazlewood Exemption. However, being a dependent on the veteran’s tax return is one way to qualify for a transfer of hours through the Legacy Act. • “Y” for yes for recipient reported as a dependent . • “N” for no,recipient not reported as a dependent. • Either answer will be accepted and will not hold up the certification of the file. Data Element 15: Indicates whether or not the Hazlewood recipient is reported as a dependent on the qualifying veteran’s taxes. Hazlewood Exemption Database Report
Data Element 24 Data Element 24: Indicates whether or not the service member meets at least one of the time of entry requirements. Data Element # 24: Y In order to be eligible, answer must be “Y” for yes. • Service Member Meeting Initial Time of Entry Requirement ? • In order to qualify for the Hazlewood Exemption the Texas veteran must meet at least one of the following time of entry requirements: • Enter into active duty service in Texas, • Designate Texas as their home of record at the time of entry into active duty, or • Be a Texas resident at the time of entry into the service. Error Report THECB will send an e-mail to your institution’s generic e-mail address notifying you that an error report is ready to be retrieved from the “Texas_Grants_Output” directory. Errors will be listed at the bottom of each data record in the error report. A “warning” will be listed if the recipient’s SSN did not match with the CBM001 report.
