James River Lynchburg Bacteria TMDL Background • Original TMDL, completed August, 2007 • and approved by • both EPA (12-4-2007) and • State Water Control Board (7-31-2008). • Modification #1 completed December 3, 2009 • and approved by EPA December 3, 2009. • Draft Modification #2 (and Draft Beaver Creek TMDL addition) completed May 2010.

Bacteria TMDL Redevelopment Process Description • Formerly completed TMDLs may be reopened for various reasons such as, to consider the effects of additional Waste Load Allocations or significant land use changes. • When changes to the TMDL are initiated by a permittee, such as the City of Lynchburg, the costs of remodeling may be passed along to the permittee.

  9. Bacteria TMDL Redevelopment Process Description • Who’s responsible? The delegated regulatory authority to develop, review, edit, provide public participation, and submit a TMDL to EPA and the SWCB remains the responsibility of the Department of Environmental Quality. • How many changes should be made? During the ‘redevelopment’ process, updates to other aspects of the original modeling, equations, and report may be made as appropriate to reflect changes, such as the bacteria water quality standards and assessments, mapping, nonpoint source load allocations, waste load allocations, hydrologic features, and land use. • Do TMDL Goals change? The process although initiated by a slightly different path, has the same state and federal regulatory expectations to achieve Water Quality Standards and receive EPA and State Water Control Board approval as any other TMDL.

  10. LTCP Changes Considered TMDL Modification #2 included a simple modeling scenario that considered whether bacteria Water Quality Standards might still be met if some limited discharge of mixed stormwater and sewage in combined sewer overflow events were to remain in the James River.
