Progressive constraints on fleet capacity imposed by EU law Extension of MAGP IV Revision of tonnage objectives to take account of re-measurement All fleet has to be measured in GT Conversion of tonnage objectives GRT → GT Re-segmentation of the fleet No more aid to build vessels MAGP IV objectives (expressed in GT* for tonnage) Capacity withdrawn with aid not to be replaced. Capacity built with aid has to be compensated by capacity withdrawn without aid MAGP III objectives MAGP IV objectives (GT* for tonnage) Capacity withdrawn with aid not to be replaced. FRAMEWORK REGULATION(R.2371/2002) CHAPTER II conservation and sustainability • Article 4.2 e) on fixing of number and type of fishing vessels authorised to fish and f) on fishing effort limitations. • Article 5. 4 : recovery plans shall include fishing effort limitations … having regard to the characteristics of the fisheries …. • Article 6. 4 : management plans may include fishing effort limitations … having regard to the characteristics of the fisheries

Framework Regulation (R. 2371/2002) Chapter III adjustment of fishing capacity • Article 11 : adjustment of fishing capacity : decommissioning schemes are required to ensure balance between fleets and stocks. Capacity withdrawn with aid cannot be replaced. Entry of « safety tonnage » possible without penalty.
